<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 -15 <br />By: Mayor O'Grady <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SAFETY <br />TO REQUEST PROPOSALS FOR PLANS EXAMINER AND BACK-UP <br />PLANS EXAMINER SER VICES; AND FUR THER A UTHORIZING THE <br />MAYOR, SUBJECT TO APPROVAL OF THE BOARD OF CONTROL, TO <br />ENTER INTO A TWO-YEAR AGREEMENT WITH THE EXAMINERS <br />SELECTED IN THE RFP PROCESS AND DECLARING AN EMERGENCY <br />AS AMENDED. <br />WHEREAS, the specifications for Requests for Proposals for a Plans Examiner and <br />Back-Up Plans Examiner are on file in the office of the Director of Public Safety; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public Safety to <br />solicit proposals for said Plans Examiner and Back-Up Plans Examiner services and to further <br />authorize the Mayor, upon approval of the Board of Control, to enter into an Agreement for <br />services with the most qualified individual to perform the services at a price that is fair and <br />reasonable to the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Safety be and he hereby is authorized to <br />request proposals from persons qualified to provide Plan Examination Services and Back-Up <br />Plan Examination Services to the City's Building Department. A copy of the said Request for <br />Proposals is attached to this Ordinance as Exhibit A. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the <br />Board of Control, to enter into an Agreement or Agreements with the person and/or firms <br />selected in the RFP process. Said Agreement shall be in the form of the Agreement attached to <br />this Ordinance as Exhibit B, with such additional modifications and changes in form or in <br />substance that are not substantially adverse to the City and which are approved by the Director of <br />Law. The character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the <br />Agreement by the Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary this legislation go into effect immediately to provide suffic;Ant <br />time far the RFP process to be conducted and completed prior to June 1, 2007, the date upon <br />which the terms of the current contracts end; and further provided that it receives the affirmative <br />vote of two-thirds of all members of Council, it shall take effect and be in force immediately <br />upon its passage and approval by the Mayor. <br />.r .. . .. . ... ? ...... .. . . ....... . . .. ...lM?•`r.?e.,?«.. . . .,.:.? ks.ki..bra .....
