<br />Ordinance No. 2007-20 <br />plans and building elevations incorporate all reguirements of the final development <br />plan approved by City Council Any deviations from the said final development <br />plan approved by City Council must be urominently noted on the submitted site <br />developmentplan and building elevation. Acceptance bv either the Building <br />Department or the Engineering Department of a site develonment ulan or buildin? <br />elevation that does not incorQorate all of the requirements of the final development <br />plan approved by City Council, or that contaiws deviations from the said final <br />development plan, shall not constitute a waiver by the City of anv of the <br />rec?uirements of the final development Qlans aQproved bv City Council. An owner <br />or owner's representative who falselvi certifies or fails to note deviations on a site <br />development plan or building elevation as required bv this paraeraph shall be <br />subject to all of the actions bYthe City authorized bv Chapter 1121 and to the <br />criminal penalties provided for in Section 1121.99(b). <br />(be) It shall be a defense to any such action brought by the City, whether <br />criminal or civil in nature, that the Building Official expressly authorized a minor <br />deviation from an owner's approved plans as a result of a field inspection of the <br />property conducted by the Building Official. <br />(ed) For purposes of subsections (a) and b hereof, "rinal development <br />plans" appfeyed" means the finally approved building, sign and site deyelopmel.i.t. Plans <br />for the property, the landscaping and lighting plans for the property, and all statements <br />concerning the use and/or development of the property appearing affirmatively on the <br />face of the record of the proceedings of the owner's application for a building permit <br />which were expressly made a condition of Planning and Design Commission's and <br />City Council's approval pursuant to the provisions of Section 1126.08 and/or <br />1126.09 of this Chapter. <br />tieil. <br />SECTION 2: That the Clerk of Council be and she is hereby directed to cause <br />notice of a Public Hearing hereon to be given pursuant to the provisions of Section 14 of <br />Article IV of the Charter of the City of North Olmsted and Section 1127.03 of the North <br />Olmsted Zoning Code. <br />SECTION 3: That, in all other respects, the North Olmsted Zoning Code, as <br />amended and supplemented from time to time, shall remain in full force and effect. <br />SECTION 4: That the original Section 1126.11 of the Zoning Code amended <br />herein is expressly repealed, and all other ordinances or resolutions, or parts of <br />ordinances or resolutions, that are inconsistent or in conflict with new section 1126.11 of <br />the Zoning Code, are likewise repealed to the extent of such inconsistency or conflict <br />only. <br />.. ?ix;?w, . •+wmwr,s'a . . 9 r ? <R--..v.wW...
