, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 24 <br />BY: Mayor O'Grady <br />AN ORDINANCE EXTENDING FOR A ONE HUNDRED TWENTY DAY <br />PERIOD THE TEMPORARY, PART-TIME FIRE ADMINISTRATOR <br />POSITION IN THE NORTH OLMSTED FIRE DEPARTMENT CREATED <br />BY ORDINANCE NO. 2006-157, AND DECLARING AN EMERGENCY.. <br />WHEREAS, this Council, on September 12, 2006, adopted Ordinance No. 2006-157, <br />which created a temporary, part-time fire administratar position in the Fire Department; and <br />WHEREAS, Ordinance No. 2006-157 specified that the temporary position would <br />terminate on the earliest of the following three events: (1) one hundred twenty (120) days from <br />the date of said temporary appointment, (2) the return of the present Assistant Fire Chief to duty, <br />or (3) the appointment of a new Assistant Fire Chief; and <br />WHEREAS, as the result of circumstances beyond the control of the City <br />Administration, the Assistant Fire Chief never returned to duty, but did not officially retire until <br />February 27, 2007, and the Fire Department requires the Fire Administrator to continue <br />providing vital safety services to the City far an additional one hundred twenty additional days, <br />which is estimated to be the time needed to conduct a civil service examination, create an <br />eligibility list and appoint a new Assistant Fire Chief; and <br />WHEREAS, the Administration accordingly desires to extend the temporary position of <br />the part-time Fire Administrator for an additional one hundred twenty days or until the date upon <br />which the new Assistant Fire Chief is appointed, whichever event first occurs; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That the temporary, part-time position of Fire Administrator in the North <br />Olmsted Fire Department is hereby extended far an additional one hundred twenty days from the <br />effective date of this ordinance, or until the new Assistant Fire Chief is appointed, whichever <br />event first occurs. <br />SECTION 2: Other than the changes noted above in Section 1, all other provisions of <br />Ordinance 2006-157, including duties and pay range, shall remain in effect. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to extend this temporary position which serves <br />vital safety needs of the City because otherwise the position will terminate on March 15, 2007, <br />and further provided it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />
