tvlk <br />By: Mayor O'Grady <br />?14 <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 26 <br />AN ORDINANCE ADOPTING A MODEL ORDINANCE FOR <br />ILLICIT DISCHARGE AND ILLEGAL CONNECTION CONTROL <br />AND CREATING NEW CHAPTER 933 OF THE UTILITIES CODE . <br />WHEREAS, illicit discharges to the City of North Olmsted separate storm sewer system <br />create water quality risks to public health, safety, and general welfare; and <br />WHEREAS, illicit discharges may necessitate repair of storm sewers and ditches; damage <br />to public and private property; and may damage water resources by reducing water quality; and <br />WHEREAS, there are watershed-wide efforts to reduce illicit discharges to the Rocky <br />River and Lake Erie and to protect and enhance the unique water resources of the Rocky River <br />and Lake Erie watersheds; and <br />WHEREAS, the City of North Olmsted recognizes its obligation to control illicit <br />discharges and to protect water quality within its borders; and <br />WHEREAS, 40 C.F.R. Parts 9, 122, 123, and 124, and Ohio Administrative Code 3745-39, <br />require designated communities, including the City of North Olmsted, to develop a Storm Water <br />Management Program that, among other components, requires the prohibition of illicit discharges <br />to their storm water systems and the implementation of appropriate enforcement procedures and <br />actions to detect and eliminate such illicit discharges; and <br />WHEREAS, Article XVIII, Section 3 of the Ohio Constitution grants municipalities the <br />legal authority to exercise all powers of local self-government and to adopt and enforce within <br />their limits such local police, sanitary, and other similar regulations, as are not in conflict with <br />general laws; <br />NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO, THAT: <br />SECTION 1: That this Council adopts the model code created by the Chagrin Rivers <br />Watershed Partners, Inc., and accordingly creates new Chapter 933 of the Utilities Code, entitled <br />"Illicit Discharge and Illegal Connections Control," which, as created, shall be in the form and <br />contain the provisions set forth in Exhibit A attached hereto, which is incorporated by reference <br />as if fully rewritten herein. <br />SECTION 2: That all ordinances or parts of ordinances in conflict or inconsistent with <br />the provisions of new Chapter 933, to the extent of any such conflict or inconsistency with the <br />provisions of new Chapter 933, are hereby repealed. In addition, wherever the wards "public <br />sewers" are used in Chapter 917 (Industrial Pretreatment), consistent with this repealer, the words <br />"sanitary sewers" shall be substituted therein. <br />SECTION 3: That this Ordinance shall take effect and be in farce from and after the <br />earliest date provided for by law. <br />
