CITY OF NORTH OLMSTED ORDINANCE NO. 2007 - 30 -41_ BY: Mayor O'Grady and Council Members Miller, Gareau, Orlowski, Tallon, Barker and Jones AN ORDINANCE AMENDING SECTION 1135.02 OF CHAPTER 1135 (ONE AND T WO FAMIL Y RESIDENCE DISTRICTS) OF THE ZONING CODE IN ORDER TO REGULATE THE PLACEMENT OF PORTABLE STORAGE CONTAINERS IN ONE AND TWO FAMILY RESIDENCE DISTRICTS OF THE CITY OF NORTH OLMSTED AS AMENDED. WHEREAS, the use of Portable Storage Containers, sometimes referred to as P.O.D.S. (Portable On-Demand Storage) structures, has increased in residential neighborhoods of the City of North Olmsted; and WHEREAS, this Council finds, based upon recommendations by the Director of Planning and the Building Commissioner, that the placement of these storage containers in residential areas has an adverse impact on neighborhoods and should be regulated in order to maintain the appearance of residential neighborhoods and protect residents' quiet and peaceful enjoyment of their residential properties; and WHEREAS, it is the desire of this Council to accordingly amend Section 1135.02 of the Zoning Code, as recommended by the Director of Planning and the Building Commissioner, to appropriately regulate the placement of portable storage containers in residential neighborhoods in North Olmsted; and WH?REAS, the Planning & Design Commission on the A day of , 2007, by formal motion, (recommended - did not recommend) (with su g sted changes) that this Ordinance be adopted; and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Articl V of the Charter of the City of North Olmsted and Section 1127.03 of the Nortl? lmsted ?o ing Code, a public hearing was held on this proposed legislation on the 1day of , 2007; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That Section 1135.02 (Accessory Uses and Buildings) of Chapter 1135 (One and Two Family Residence Districts) of the City of North Olmsted Zoning Code, which presently reads in its entirety as set forth in the document attached to this Ordinance as Exhibit A and incorporated herein by reference as if fully restated herein, be amended, and, as amended, shall read in its entirety as set forth in the document attached to this Ordinance as Exhibit B and incorporated herein by reference as if fully restated herein.
