CITY OF NORTH OLMSTED RESOLUTION NO. 2007 - 33 By: Mayor O'Grady A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MULTI-JURISDICTIONAL AGREEMENT FOR THE INTERCHANGE OF BOMB SQUAD AND/OR SWAT UNIT SERVICES, AND DECLARING AN EMERGENCY. WHEREAS, the Mayor has recommended that the City of North Olmsted enter into a multi jurisdictional agreement for the interchange of bomb squad services and/or swat unit services to better provide for the safety of residents of North Olmsted; and WHEREAS, this Council deems it to be in the best interests of the safety of the residents of the City to enter into such an agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor of the City of North Olmsted be and he is hereby authorized to enter into a multi jurisdictional agreement for the interchange of bomb squad services. Said agreement shall be substantially in the "Agreement between the cities of Bay Village, Lakewood, Rocky River, Cleveland, Fairview Park, North Olmsted, and Westlake, for the Interchange of Bomb Squad Services and/or Swat Unit Services," marked as Exhil,it "A" and attached hereto, with only such changes therein as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. In addition, the Mayor is hereby authorized to execute any additional, related agreements necessary to reflect City of North Olmsted authorization for the West Shore Council of Governments (WCOG) and/ar the West Shore Enforcement Bureau (WEB) to provide to and/or accept from the City of Cleveland such bomb squad and/or Swat Unit services. SECTION 2: That the Director of Finance is authorized and directed to issue warrants of the City of North Olmsted to all necessary parties to pay for the City's share of the operation and maintenance costs as identified in the Agreement. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and funY_:r for the reason that it is necessary that this Resolution go into effect immediately in order to provide increased bomb squad and swat unit services to the City at the earliest possible opportunity, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
