? <br />. .? <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 41 <br />BY: Mayor O'Grady <br />AN ORDINANCE A UTHORIZING THE MA YOR TO ENTER <br />INTO A GROUND LEASE WITH OPTIONAGREEMENT WITH <br />T-MOBILE AND APPROVING SITE DEVELOPMENT TO <br />L OCA TE A CELL ULAR MONOPOLE TO WER AND <br />FACILITIES AT FIRE STATION #2, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this Council previously adopted Ord. No. 98-130, enacted in 2000, to enable <br />the City and other property owners to locate Wireless Telecommunication Facilities and Monopole <br />Towers within an Overlay District in accordance with federal law; and <br />WHEREAS, this Council has previously authorized a ground lease for and the construction <br />of a cellular tower on City-owned property at Clague Park, which provided revenue for the <br />enhancement of park facilities, reduced the proliferation of tower facilities, and preserved the <br />residential character of the surrounding neighborhood; and <br />WHEREAS, T-Mobile Central LLC, a Delaware Corporation [hereinafter "T-Mobile"], has <br />proposed to enter into a Ground Lease with Option Agreement to construct a monopole cellular <br />tower and support facilities at Fire Station #2; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into the proposed <br />Ground Lease with Option between T-Mobile and the City of North Olmsted, and to thereby <br />authorize construction of a monopole tower and support facilities at Fire Station #2; and <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to sign, on behalf of the City of North <br />Olmsted, and enter into a Lease Transmittal & Ground Lease with Option with T-Mobile Central <br />LLC., for the purpose constructing a monopole cellular tower and related facilities at City-owned <br />property known as Fire Station #2, 29592 Lorain Road. Said Agreement shall be substantially in the <br />form of the "Lease Transmittal & Ground Lease with Option" marked as Exhibits "A," and attached <br />hereto, with only such changes therein as are not substantially adverse to the City and which are <br />approved by the Director of Law. The character of any such changes as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor <br />and the approval of the Agreement by the Director of Law. <br />,:.,+n ?.'. . .. ..., .. . ... _ . . . _ . . . _. . . . . .. ... . . .
