?, . <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2007 - 51 <br />By: Mayor O'Grady <br />A RESOLUTION RETROA CTIVEL Y ACCEPTING A FY2007 COMMUNITY <br />DEVELOPMENT BLOCK GRANT ("CDBG') FROM CUYAHOGA COUNTY <br />PROVIDING FUNDING FOR A PROJECT TO CONDUCT AN <br />ASSESSMENT OF CITY FACILITIES AND SERVICES FOR <br />COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT <br />(ADA), RATIFYING THE MAYOR'S ACTIONS IN EXECUTING A <br />CONTRACT WITH CUYAHOGA COUNTY SETTING FORTH THE TERMS <br />AND CONDITIONS OF THE GRANT, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, on October 17, 2006, this Council adopted Resolution No. 2006-167, <br />authorizing and directing the Director of Planning to make application on behalf of the City for <br />Community Development Block Grant ("CDBG") funding for a project to conduct an assessment <br />of City facilities and services for compliance with the Americans with Disabilities Act (ADA); <br />and <br />WHEREAS, earlier this year, the Cuyahoga County Department of Development <br />announced that a grant in the amount of Thirty Thousand Dollars ($30,000.00) had been made to <br />the City of North Olmsted for funding for the said ADA assessment project; and <br />WHEREAS, it is the desire of this Council to retroactively accept the said grant and to <br />ratify the actions of the Mayor in executing a contract with Cuyahoga County providing for the <br />terms and conditions upon which the said award of funding has been made to the City; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City of North Olmsted retroactively accepts the FY2007 <br />Community Development Block Grant ("CDBG") in the amount of Thirty Thousand Dollars <br />($30,000.00) for funding for a project to conduct an assessment of City facilities and services for <br />compliance with the Americans with Disabilities Act (ADA), and ratifies the Mayor's actions in <br />executing a contract with Cuyahoga County providing for the terms and conditions of the said <br />grant. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for• the <br />further reason it is necessary that this legislation go into effect immediately to legalize City <br />actions previously taken in connection with this project without formal Council approval, and <br />further, provided it receives the affirmative vote of two-thirds of all members of the Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />
