<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 52 <br /> <br />BY: Council Members Orlowski, Barker, Gareau, Jones, Miller and Tallon <br />AN ORDINANCE AMENDING SECTION 505.1 S OF CHAPTER SOS <br />(ANIMALS AND FO WL) OF THE GENERAL OFFENSES CODE, <br />ENTITLED "KEEPING, MAINTAINING AND FEEDING OF WILD <br />ANIMALS," IN ORDER TO PROHIBIT DISPLAYING, <br />MAINTAINING OR IN ANY OTHER MANNER KEEPING WILD <br />ANIMALS AT TEMPORARY EVENTS OR RETAIL STORES IN THE <br />CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City Animal Warden, as the result of a recent incident involving <br />the display of wild animals at a temporary exhibition in a nearby community, is <br />concerned that, under current North Olmsted ordinances, a similar incident could occur in <br />North Olmsted, that would jeopardize the safety of North Olmsted residents; and <br />WHEREAS, this Council, upon review, finds that displaying, maintaining, or in <br />any other manner keeping wild animals at temporary events or at retail stores in the City <br />of North Olmsted poses a substantial risk to the safety of residents; and <br />WHEREAS, it is accordingly the desire of this Council to amend Section 505.15 <br />of the General Offenses Code in order to prohibit displaying, maintaining or in any other <br />manner keeping wild animals at temporary events or at retail stores in North Olmsted; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 505.15 of Chapter 505 (Animals and Fowl) of the <br />General Offenses Code, which presently reads as follows: <br />505.15 KEEPING, MAINTAINING AND FEEDING OF WILD ANIMALS. <br />(a) Definition "Wild Animal". Any living wild or potentially dangerous <br />mammal, reptile, fowl, or other animal species which is not naturally tame or gentle, <br />but is of a wild nature or disposition and not customarily domesticated, and which <br />because of its characteristics may constitute a danger to human life or property if it <br />escaped from secure quarters. A wild animal shall include, but not be limited to: <br />(1) All poisonous snakes and constricting snakes exceeding six feet. <br />(2) Bears (Ursidae). <br />(3) Cheetahs (Acinonyx jubatus). <br />(4) Coyotes and coyotes-dog hybrids (Canids). <br />(5) Hyenas (Hyaenides). <br />(6) Jaguars (Panthera onca). <br />(7) Leopards (Panthera pardus). <br />(S) Lions (Panethera leo). <br />(9) Lynxes (lynx). <br />(10) Pumas, also known as cougars, mountain lions and panthers <br />(Felis concolor). <br />, . . u. . , <br />-11
