AGREEMENT between OHID BUREAU OF WORt<ERS' COMPENSATION <br />and City of North Olmsted <br />Employers Full Legai N;une <br />Agreement 6etween the Ohio Bureau oi Woricers' Compensation and Employer <br />This is an agreement by and between City Of NOrth Olmsted (hereinafter, " City place <br />5200 Dover Centerye1C03QulName // O?O EmplayerName <br />oi business located at , Ohio `?`? , and the State oi OhioBureau oi Workers' Compensation ihere.inattei, <br />e,i,i.,.« ZIP Code <br />the "BWC"1, Iiaving ofiices at 30 W. 5pring St., Columbus, Ohio 43215-2256, entered into the day, inonth and year set out below. <br />Whereas, the administrator oi workers' conipensation may issue a yrant to <br />deiray the costs incurred by an employer who elects to participa'1e iii BWCs Drug- <br />Free 1Norl<place Prograrn (DFWP) or drug-free workpiace program for small <br />employers (Drug-Free EZ) or a BWGapproved comparable program (hereinafter <br />re(erred to as comparable program), pursuant to Ohio Administrative Code Rule <br />IOAC) 4123-17 -50 or 4123-17-58.1, as it currently exists or as amended from time <br />to tinie; <br />Therefore, for good and valuable consideration, the sufiiciency oi which is <br />acknowledged, the parties mutually agree to the following: <br />Conditions precedent - Approval of a druy-free safety grant is continyent <br />upon the followlny (11 approval of the employer's application to participate in <br />DFWP or Orug-Free EZ or a comparable program, and (2) the employer being an <br />active, timely premium payroll customer of the Ohio State Insurance Fund as of <br />the date of execution of this agreement and for the duration hereoi. Acceptance <br />of an employer's comparable program is contingent upon submission of proof of <br />compliance with all program elemems. <br />Tasl< description - An employer in consideration of the grant given to it to <br />participate in DFWP or Drug-Free EZ promises to institute all of the following: a <br />written substance policy that is developed by the employer or its leyal counsel <br />or subjected to legal review, drug antl alcohol awareness educational sessions <br />tor all employees, a supervisor training program, tlrug and alcohol iesting <br />Iconsisting, at minimum of pre-employment, reasonable suspicion, post-accident <br />and return-to-duty testing) and employee assistance, all of which shall meet or <br />exceed the reyuiremenis of OAC 4123-17-58 or 4123-17-58.1. To be considered <br />eliyible, a comparable program must satisfy all of the reyuirements set forth <br />above as well as in the application and in OAC 4123-17-58 or 4123.58.1, which <br />are hereby incorporated herein by reference. The employer shall verify with BWC <br />6y invoice/receipt and checl< copy that the grant money was utilized for the <br />iniended purpose. <br />Eligi6ility and distribution of grant monies- The tlistribution of <br />any druy-free grant money to an employer participating in DfWP or Drug- <br />Free EZ, or a comparable program is su6ject to the Conditions Precetlent <br />provision and to available resources of BWC. Payments under DFWP or <br />Drug-Free EZ may cover legal review and development of a written <br />substance policy, druy and alcohol awareness educational sessions for <br />all employees, a supervisor training program and assessment services <br />it part of a BWC-approved consortium package. If an employer has a <br />comparable proyram, paymenis will cover only drug/alcohol awareness <br />educational sessions for all employees antl a supervisor training proyram <br />The lotal sum oi the _yrant to be issued to a private employer shall not <br />exceed a 2-to-1 ratio oi monies contributetl by the employer, i.e., a private <br />employer shall be eligible for a grant, ihe total sum oi which shall not <br />exceed a maximum of $10,000 for the private employer who contributes <br />By my siynature, I agree to iully comply with The tenns and conditions of the program and utilize all monies solely for the purposes intended. D; VVP/DF-c? 200G RSF FeL I4 200-i <br />up io a maximum of 55,000 A public employer shail be eligible (or a gram, <br />the total sum oi which shall noi exceed a 3-to-1 ratio oi monies oomributed <br />by the employer, i.e., a pu6lic employer shall be eliyibte ior a yrant, the <br />tutal sum of which sliall not exceed e maxirraum of x1G,UD0iorthe public <br />employer who contributes up to a maximuin oi $5,000 - BWC will not issue <br />a grant which exceeds S10,D00 for a private employer or ? 15,000 for a <br />Gublic employer. in the event that ihe mar,imum amount is not utilized by <br />an employer during the term oi this agreement, the employer may choose <br />to reapply, provlded that the previous yrani conditions have been satisiied. <br />BWC e>:pressly reserves the riyht to limit the amouni of reimhursements ancl ic set <br />caps on such reimbursements for eaeh and every specific reimbursable drug-iree <br />service. <br />Time of performance - An employer participating in DFWP or Druy- <br />Free EZ shall have one year from the date of the check to fulfill any <br />and all reyuirements as enumerated in OAC 4123-17-58 or OAC 4123- <br />17-58.1. After the one year deadline has expired, the employer is <br />required to submit to BWC, within 30 days of the one year expiration <br />date, a check for all unused grant monies, original invoices pertaining <br />to services utilized and/or purchased and copies of cancelled checks <br />ta document all funds were expended in the manner intended; <br />otherwise the employer slSall be responsible for repaying to the <br />bureau the outstanding balance. In the event an employer participaiing <br />In DFWP or Drug-free EZ has not utilized the maximum amount of money <br />available, it may reapply for additional funds until it has receivred the <br />maximum amouiit as indicated in Eligibility and Distribution of Grant Monies <br />provision. An employer participatiny in a camparable program shall hzve <br />one year from the date of the checl< lo fulfili any and all requirement: as <br />enumerated in the application. In the event an employer participating in a <br />comparable program has not utilized the maximum amount of money <br />availabie, the employer may reapply through submitting a new appiication <br />until it has received the maximum amount as indlcated in Eliyibiliiy and <br />Dlstribution o( Grant Monies provision. <br />Disyualification - If for any reasor? an employer participating in DFWP <br />or Drug-Free EZ, or a comparahle program fails tc satisfy the requirements <br />enumerated in the Task Description and OAC 4123-17-58.1, includiny, but <br />not limited to the requirement of maintaining active coverage and timely <br />payments thereof, it may be tlisqualiiied. An employer may also be <br />disqualified for failing to verify by invoice/receipt and check copy that the <br />grant money was utilized for the intended purposes. Disqualification will <br />resuli in the termination of BWC s obligations under this agreement. <br />BWC reserves the rightto recover the misappropriated grant monies <br />by the following methods: billing the employer for the grant money <br />received, forwarding the employer s information to the Ohio Attorncy <br />General for coilection, by set-off, recoupment or other administrative, <br />civil and/or legal remedy. <br />
