CITY OF NORTH OLMSTED ORDINANCE NO. 2007 - 63 BY: Mayor O' Grady ? AN ORDINANCE CREATING NEW SECTION 111.011 OF THE ADMINISTRATIVE CODE, ENTITLED "CITY POLICE TOWING AND STORAGE CONTRACTS, " IN ORDER TO AUTHORIZE THE MAYOR TO EXECUTE TOWING AND STORAGE CONTRACTS WITH TOWING CONTRACTORS WHO MEET NORTH OLMSTED POLICE DEPARTMENT RULES AND REGULATIONS. WHEREAS, the North Olmsted Police Department, from time to time, and on a non- consensual or involuntary basis, summons tows and orders vehicles into storage pursuant to the provisions of Section 303.08 of the City Traffic Code; and WHEREAS, the Chief of Police, at the request of the Mayor and Director of Public Safety, has reviewed the manner in which such tows are conducted in North Olmsted, and, after having completed said review, recommends that this Council adopt legislation requiring that such tows be conducted by contractors who have entered into contracts with the City, and further authorizing the Mayor to enter into contracts with any and all towing contractors who meet police department rules and regulations for conducting non-consensual tows and storing vehicles pursuant to such tows; and WHEREAS, it is the desire of this Council, acting upon the recommendation of the Chief of Police, to create new Section 111.011 of the Administrative Code providing for all police department non-consensual tows to be conducted by towing contractors who have entered into contracts with the City, and authorizing the Mayor to enter into contracts with any towing contractor who meets police department rules and regulations for conducting non- consensual tows; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That there be and hereby is created new Section 111.011 of Chapter 111 ("City Contracts") of the Administrative Code of the City of North Olmsted, which, as created, shall read in its entirety as follows: "111.011 CITY POLICE TOWING AND STORAGE CONTRACTS. (A) Except under emergency circumstances which prevent strict compliance with the provisions of this Section, the North Olmsted police department, when calling for tows and ordering vehicles into storage pursuant to the provisions of Section 303.08 of the Traffic Code, shall only call towing contractors that have entered into contracts with the City pursuant to the provisions of this Section.
