<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 76 <br />By: Mayor O'Grady <br />AN ORDINANCE ACCEPTING A WATER MAIN EASEMENT <br />LOCATED ON PROPERTY OWNED BY GREATER <br />CLEVELAND REGIONAL TRANSIT AUTHORITY (GCRTA), <br />AS FURTHER DESCRIBED AND RECORDED ON THE <br />CUYAHOGA COUNTY MAPS AND RECORDS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, GCRTA has offered an easement to the City of North Olmsted for a <br />water main known as being part of the Original Olmsted Township Lot No. 39, Tract No. G, as <br />further described, in the vicinity of the terminus of Kennedy Ridge Road, generally westbound <br />toward the GCRTA Park N Ride; and <br />WHEREAS, this Council desires to obtain from said owner a permanent easement for <br />water main purposes to locate and install now, and in the future, a water line on said property; <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation of <br />the Director of Service and the City Engineer, to accept this easement and to provide for the <br />recording of such conveyance; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the City of <br />North Olmsted, a water main easement from Greater Cleveland Regional Transit Auth-_ity <br />(GCRTA), the owner of certain real property as further described within the Standard Easement <br />form, marked as Exhibit A attached hereto and incorparated herein by reference. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed <br />to cause said easement to be recorded in the Office of the Cuyahoga County Recarder. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to obtain said water main easement in accordance with <br />regulations, and further provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage. <br />
