<br />Ordinance No. 2007-82 <br /> <br /> <br />i <br />d <br />n <br />oof , , <br />, • <br />(c) A license holder may, consistent with the provisions under subsection <br />(b) (4) hereof, place a charitable donation box on a private sidewalk or otherwise <br />upon a commercial premises that meets the following requirements: <br />(1) Not more than one (1) receptacle; <br />(2) Not more than three (3) feet wide, four (4) feet deep and <br />seven (7) feet tall in size; <br />(3) Located or placed no less than seventy-five (75) feet from the <br />right-of-way; <br />(4) Non-illuminated and without electrical supply; <br />(5) Contact or identification information panel with name, <br />address and emergency phone number; <br />(6) Not more than two (2) sign panels measuring not more than <br />three (3) by three (3) feet in area. <br />(d) For commercial properties with frontage or lot size or lot <br />configuration insufficient to accommodate the setback requirement of (c)(3) above, <br />the Safety Director may permit a lesser setback upon the submission of a plan or <br />diagram which depicts the alternate location of such receptacle, and which plan <br />denotes the express written consent of the property owner. Any setback reduction <br />granted by the Safety Director shall be clearly noted on the license, depicted on the <br />approved plan, and enforced by the Building Department pursuant to Section <br />755.04. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and further for the reason that it is necessary that this Ordinance go into effect <br />immediately due to the persistent request for and installation of external storage <br />receptacles or outdoor drop boxes; further provided it receives the affirmative vote of <br />two-thirds of all members of Council, it shall take effect and be in force immediately <br />upon its passage and approval by the Mayor. <br />PASSED: <br />First Reading: a <br />Second Reading: a 9 <br />Third Reading: ? <br />Committee: <br />Ytc? <br />3 <br />, ,
