<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2007-87 <br />BY: Mayor O'Grady <br /> <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF PUBLIC <br />SER VICE TO SOLICIT BIDS FOR THE COLLECTION AND <br />DISPOSAL OF SOLID WASTE AND RECYCLABLE MATERIALS; <br />AND FURTHER AUTHORIZING THE MAYOR, UPON APPROVAL <br />OF THE BOARD OF CONTROL, TO ENTER INTO A CONTRACT <br />WITH THE LOWEST AND BEST BIDDER. <br />WHEREAS, the current term of the City's contract with Browning-Ferris <br />Industries of Ohio, Inc., now operating as "Allied Waste", for the collection and disposal <br />of solid waste and recyclable materials expires on December 31, 2007; and <br />WHEREAS, the said contract provides for one final automatic one-year term <br />renewal for the year 2008 if neither the City nor Allied Waste, within 120 days prior to <br />the end of the current term, notifies the other of its intent to terminate; and <br />WHEREAS, it is the recommendation of the Director of Public Service that the <br />City renew its contract with Allied Waste for the year 2008 if the latter does not elect to <br />terminate its contract with the City, but, if Allied Waste does elect to terminate the <br />contract this year, then to advertise for bids for a new contract effective January 1, 2008, <br />in accordance with the specifications on file in his office; and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the request <br />of the Director of Public Service for authority to bid in the event that Allied Waste elects <br />to terminate its contract with the City, to authorize the Director of Public Service to <br />proceed with and solicit bids for the collection and disposal of solid waste and recyclable <br />materials in accordance with the specifications on file in his office, and to further <br />authorize the Mayor, following approval of the Board of' Control, to enter into a contract <br />with the lowest and best bidder; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby authorized <br />to advertise for bids for the collection and disposal of solid waste and recyclable <br />materials in accordance with specifications now on file in his office, and further that, <br />upon approval by the Board of Control, the Mayor is hereby further authorized to enter <br />into a contract and execute the same on behalf of the City of North Olmsted with the <br />lowest and best bidder. <br />
