<br />failure of this condition precedent, for any reasons cited hereinabove, shall render the <br />agreement void, without recourse or claim by the Instructor. <br />Section III <br />Manner of Performance of Services <br />Instructor agrees to perform, at all times faithfully, industriously, and to the best <br />of her ability, experience, and talent, all of the duties that may be required of and from <br />her pursuant to the express and implicit terms of this agreement, to the reasonable <br />satisfaction of the City. Such duties shall be rendered at North Olmsted Recreation <br />Complex, and at such other place or places as reasonably necessary for gymnastic <br />instruction, so long as the participants are transported to such offsite locations by and <br />have the permission of parents and/or guardians to participate and that the gymnastics <br />competition, facility and equipment is sanctioned by the Amateur Athletic Union/United <br />States Association of Gymnastics (AAU/USAG), <br />Such responsibilities of Instructor shall include, but are not limited to: <br />l. Operate classes only during hours approved by the Recreation Complex <br />management. <br />2. Assume all responsibilities of programming subject to obtaining approval for <br />all programs from the City's Recreation Commission prior to the public <br />release of any information on programs. <br />3. Provide information necessary to register, organize, and advertise classes and <br />programs conducted or supervised by Instructar. Such information will <br />include class length, time, cost, and other details as necessary or as demanded <br />by the City. <br />4. Provide proper supervision and qualified instructors for all programs <br />conducted by Instructor. All Instructors shall be certified via safety training in <br />accordance with the USAG manual and thereby clearly demonstrate <br />lcnowledge of safety precautions for gymnastics instruction. <br />5. Hire, fire, pay, supervise, and schedule all instructors. <br />6. Refuse to allow participation in classes, lessons, or activities by unregistered <br />or improperly registered persons. <br />7. Allow designated Recreation Department programs and classes to use the <br />Gymnastics room and springboard floor located therein, but not the <br />gymnastics equipment of Instructor, pravided proper supervision is <br />maintained, such as North Olmsted Karate, and other programs operated or <br />approved by the City, provided however, that such activities do not conflicf <br />with the schedule of existing, established or scheduled gymnastic programs, <br />which may vary or expand from time to time. <br />8. Instructor shall be responsible for maintaining the inventory of all gymnastics <br />equipment, as identified in Schedule A, except as herein provided, as located <br />on the second floor gym area, and Instructor shall reasonably determine, from <br />time to time, whether new equipment is needed in order to maintain the <br />facility as a state of the art facility.
