<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2007 - 98 <br />BY: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE MA YOR, ON BEHALF OF <br />THE CITY OF NORTH OLMSTED, TO ENTER INTO AN <br />AGREEMENT WITH THE NORTH OLMSTED SCHOOL DISTRICT, <br />GRANTING THE SCHOOL DISTRICT PERMISSION TO PLACE <br />BANNERS ON POLES LOCATED IN THE CITY RIGHT-OF-WAY <br />ON BURNS AND BUTTERNUT RIDGE ROADS, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, as a result of efforts by North Olmsted Police Officer Jim Carbone <br />and the North Olmsted Eagle Boosters, special Eagle Pride banners have been designed <br />and are being donated to the North Olmsted schools; and <br />WHEREAS, it is the desire of the North Olmsted School District to place the said <br />Eagle Pride banners on designated Cleveland Electric Illuminating Company ("CEP') <br />poles located on Burns and Butternut Ridge Roads to promote school spirit, and of the <br />Mayor and his Administration to participate in the project; and <br />WHEREAS, the School District has obtained permission from CEI to use its <br />designated poles for the placement of such banners; and <br />WHEREAS, it is the desire therefore of this Council to authorize the Mayor to <br />enter into an Agreement with the North Olmsted School District granting the School <br />District permission to place the said banners on CEI poles in the right-of-way on Burns <br />and Butternut Ridge Roads and providing for the City's participation in the said project; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor, on behalf of the City of North Olmsted, be and he <br />is hereby authorized to enter into an agreement with the North Olmsted School District <br />permitting the latter to place Eagle Pride banners on designated CEI poles located in the <br />City right-of-way on Burns and Butternut Ridge Roads and providing for the City's <br />participation in the project. Said agreement shall be substantially in the form as the <br />Agreement attached hereto as Exhibit A, with only such changes therein as are not <br />substantially adverse to the City and which are approved by the Mayor and the Director <br />of Law. The character of any such changes as not being substantially adverse to the City <br />shall be evidenced conclusively by the execution of the abreement by the Mayor and the <br />approval of the agreement by the Director of Law.
