e04 <br />lk.. :. <br />3.1.4 Provide to ARCHITECT all available data and information in the <br />possession of the CITY, as requested by ARCHITECT, relevant to the <br />design and construction of the PROJEC'T. <br />3.1.5 Give prompt written notice to ARCHITECT whenever the CITY <br />observes or otherwise becomes aware of any event that affects <br />ARCHITECT'S performance of its duties and obligations under <br />Section 1 Basic Services. <br />SECTION 4. TIME SCHEDULE <br />4.1 Unless otherwise directed by the CITY, the ARCHITECT shall commence <br />the performance of the Section 1. Basic Services upon execution of this Agreement by <br />both parties that shall constitute Authorization to Proceed. Time is of the essence in this <br />Agreement for the Section 1 Basic Services. <br />4.2 The ARCHITECT recognizes that the SERVICES under this Agreement <br />are to be performed as expeditiously as practicable. The ARCHITECT shall make every <br />reasonable effort to substantially complete the Section 1. Basic Services within the time <br />set forth in Exhibit III, Time Schedule, attached hereto and made a part hereof. <br />SECTION 5. AMOUNT AND METHOD OF PAYMENT <br />5.1 For services provided under Section 1. Basic Services, payment shall be <br />made in accordance with Exhibit II, Method of Payment. <br />5.2 All invoices shall be in the format requested by the CITY as referenced in <br />Exhibit II, Method of Payment. <br />5.3 The ARCHITECT covenants and agrees to pay all persons and corparations, <br />including employees, sub-consultants, and all other working in active concert with such <br />persons or corporations, who render services in connection with the performance of this <br />Agreement. <br />SECTION 6.
