<br />F. RIGHT-OF-WAY <br />That all existing street and public right-of-way within the MUNICIPALIT'Y which is <br />necessary for the aforesaid improvement shall be made available therefore. <br />That the COLINTY will arrange for the acquisition of any addirional right-of-way which may <br />be required for the construction of the improvement. <br />G. UTILITIES <br />That the MUNICIPALITY will make arrangements with and obtain agreements from all <br />privately owned public utility companies whose lines or structures will be affected by the said <br />improvement, and said companies have agreed to make any and a11 necessary rearrangerrients in <br />such a manner as to be clear of any construcrion called for by the plans of said improvement, <br />and said companies have agreed to make such necessary rearrangements immediately after <br />notification by said MUNICIPALITY or the COUNTY. <br />That the COLTNTY will participate in the cost of alterations of govermnentally-owned utility <br />facilities which corne within the provisions of Ohio Depazkment of Transportarion Directive 28- <br />A to the same extent that it participates in the other costs of the project, provided, however, that <br />such participation will not extend to any additions or betterments of eausting facilities. <br />That it is hereby agreed that the MLJNICIPALITY shall, at its own expense, make a11 <br />reairangements of governmentally-owned urilities and/or appurtenances thereto which do not <br />comply with the provisions of Ohio Depazrinent of Transportation Directive 28-A, whether <br />inside or outside the corporate limits, as may be necessary to conform to the said improvement, <br />and said rearrangements shall be done at such times as requested by the COLJNTY. <br />4. That the construction, reconstruction, an/or rearrangement of atl utiliries shall be done in such a <br />manner as not to interfere unduly with the operation of the contractor constructing the <br />improvement, and all backfilling of ttenches made necessary by such urility rearrangements <br />sha11 be performed in accordance with the provision of the Ohio Department of Transpartation <br />Construction and Material Specificarions and sha11 be subject to approval by the COUNTY. <br />That, if the project utilizes Federal-aid Highway Funds, the installation of all urility facilities in <br />right-of-way sha11 conform with the requirements of the Federal Highway Administration <br />Policy and Procedure Memorandum 304 "Utility Relocation and Adjustments" and the Ohio <br />Department of Transportation rules on Utility Accommodation. <br />H. MISCELLANEOUS <br />That if the COUNTY is formally requested by the MUNICIPALITY through Municipal <br />Resolution to include the construction of sanitary sewers, waterlines, area sewers (drainage of <br />area sunounding the improvement), alternate bid items, or other items in the improvement that <br />are in addirion to those now existing and not provided for elsewhere in this agreement, the <br />COUNTY will do so, provided that this construction meets with approval of the COLIN'1 Y and <br />the MLINICIPALTTY involved in this improvement; and that the MUNICIPALITY agrees to <br />pay, or make arrangements for the payment of, the cost of said addirional construction and the <br />
