? <br />& <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004 -167 <br />BY: Mayor Musial and the Entire City Council. <br />A RESOL UTION A UTHORIZING THE MAYOR TO ENTER INTO A <br />CONTRACT WITH SPORTS VENUE ADVERTISING, ING, FOR <br />7'HE PURPOSE OF SELLING ADVERTISEMENT SPACE ON THE <br />DASHERBOARDS, WALLS, AND OTHER LOCATIONS AT THE <br />RECREATION COMPLEX, AND DECLARING A1V EMERGENCY. <br />WHEREAS; the Recreation Commissioner has recommended to the <br />Administration that the City permit commercial ads to be placed on the dasherboards, <br />walls and other locations at the Recreation Complex in order generate revenues needed <br />for the continued good operation and improvement of the Complex; and <br />WHEREAS; the Recreation Commissioner has further recommended to the <br />Administration that the City enter into a contract with Sports Venue Advertising, Inc., to <br />sell space at the above-noted locations at the Recreation Complex to third-party <br />commercial advertisers; and <br />WHEREAS, the Parks and Recreation Commission has reviewed and approved <br />the said recommendations of the Recreation Commissioner; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a <br />contract with Sports Venue Advertising, Inc., to provide for the latter company to sell <br />space at the Recreation Complex to third-party commercial advertisers; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CIT.Y <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That this Council authorizes the Mayor to enter into a contract with <br />Sports Venue Advertising, Inc., to provide for the latter company to sell space at the <br />Recreation Complex to third-party commercial advertisers. Said contract shall be in the <br />form and substance of the attached contract, marked as Exhibit A and attached hereto, <br />with only such changes to be hereinafter made as are not substantially adverse to the City <br />and which are approved by the Director of Law. The character of any such changes as <br />not being substantially adverse to the City shall be evidenced conclusively by the <br />execution of the said contract by the Mayar and its approval by the Director of Law. <br />SECTION 2: That a11 proceeds received by the City from the contract between <br />the City and Sports Venue Advertising, Inc. shall be paid into the Recreation Fund.
