%6 <br />CITY OF NORTH ULMSTED <br />RESOLUTION NO. 2004 - 132 <br />BY: Mayor Musial <br />A RESOLUTION APPROVING OF AND AUTHORIZING THE <br />MAYOR TO ENTER INTO A COLLECTIVE BARGAINING <br />AGREEMENT WITH THE OHIO PATROLMEN'S BENEVOLENT <br />ASSOCIATION ("OPBA'), FOR THE CITY'S EMERGENCY <br />CENTRAL DISPATCHERS, FOR THE PERIOD JANUARY 1, 2004 <br />THROUGH DECEMBER 31, 2006, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the legislature of the State of Ohio has heretofore adopted legislation <br />calling for collective bargaining agreements with public employees; and <br />WHEItEAS, the Ohio Patrolmen's Benevolent Association ("OPBA"), has been <br />recognized as the exclusive bargaining agent for the City's Emergency Central Dispatchers; <br />and <br />WHEREAS, the Administration conducted negotiations with the members of said <br />bargaining unit in 2003-2004, agreeing with the bargaining unit representatives on most issues, <br />but ultimately submitting two issues to fact-finding for report and recommendation; and <br />WHEREAS, a fact-finding hearing was held before Fact-Finder Robert G. Stein, a <br />report with recommendations on the submitted issues was issued by Fact-Finder Stein, and the <br />Fact-Finder's report was ultimately accepted by this City Council and by the City's Emergency <br />Central Dispatchers; and <br />WHEREAS, as above noted, the Administration negotiated an agreement with OPBA <br />on a11 other issues that were the subject of collective bargaining between the Administration <br />and OPBA, regarding the City's Emergency Central Dispatchers, that was satisfactory to the <br />Administration and to the Dispatchers; and <br />WHEREAS, it is the desire of this Council to approve of and authorize the Mayor to <br />enter into a collective bargaining agreement the Ohio Patrolmen's Benevolent Association, on <br />behalf of the City's Emergency Central Dispatchers, for the period January 1, 2004 through <br />December 31, 2006; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the collective bargaining agreement negotiated by and between the <br />Administration and the Ohio Patrolmen's Benevolent Association ("OPBA"), on behalf of the <br />City's Emergency Central Dispatchers, including a11 recommendations of Fact Finder Robert <br />G. Stein, a draft copy of which collective bargaining agreement is attached to this legislation as <br />"Exhibit A," is approved and the Mayor is authorized to execute the said agreement, subject to
