shall be given written notice regarding the reasons(s) for the disciplinary action. The <br />employee shall be informed of the right to confer with a representative of the OPBA. <br />SECTION 3: Prior to any discipline being imposed, the employee shall be given the <br />opportunity to appeal through Step 3 of the grievance procedure contained in Article 10 <br />of this agreement. The employee shall then be able to appeal the S#ep 3 decision to <br />arbitration, as set forth in Article 10 of this agreement. <br />ARTICLE 10: <br />GRIEVANCE PROCEDURE <br />SECTION 1: Grievant - The "grievant" shall be defined as any employee, group of <br />employees within the bargaining unit or the OPBA. <br />Party in Interest - A"party in interest" shall be defined as any employee of the <br />Employer named in the grievance who is not the grievant. <br />Days - A"day" as used in this procedure shall mean calendar days, excluding <br />Saturdays, Sundays or Holidays as provided for in this Agrsement. <br />SECTION 2: A grievance is an unresolved question or dispute regarding wages, hours, <br />terms and conditions of employment of the bargaining unit employees, and any alleged <br />failure of the Employer to comply with all applicable law affecting the bargaining unit <br />employee, including, but not limited to unresolved questions or disputes concerning the <br />interpretation and application of this Agreement. <br />A grievance can be initiated by the OPBA or an aggrieved bargaining unit <br />employee. Where a group of bargaining unit employees desires to file a grievance <br />involving a situation affecting each such bargaining unit emplayee in the same manner, <br />one bargaining unit employee selected by such group shall process the grievance(s). <br />SECTION 3: The following procedures shatl apply to the administration of all <br />grievances filed under this procedure. <br />a) Except in Step 1, all grievances shall include the name and position of the grievant, <br />the identity of the provisions of this agreement involved in the grievance; the time <br />and place where the alleged events or conditions giving rise ta the grievance took <br />place, the identity of the party responsible for causing the said grievance, if known <br />to the grievant; and a general statement of the nature of the grievance and the <br />redress sought by the grievant. <br />b) Except at Step 1, all decisions shall be rendered in writing at each step of the <br />grievance procedure. Each decision shall be transmitted to the grievant and his <br />representative, if any.
