CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 130 <br />BY: Council Members Dailey, Miller and Kasler <br />AN ORDINANCE CREATING NEW SECTION 505.081 AND <br />AMENDING SECTION 505.08 OF CHAPTER 505 OF THE <br />GENERAL OFFENSES CODE ENTITLED "ANIMALS AND <br />FOWL, " IN ORDER TO REQUIRE THAT DOG OWNERS CARRY <br />MATERIALS OR IMPLEMENTS FOR COLLECTING FECES <br />WHILE WALKING THEIR DOGS, AND FURTHER TO MORE <br />CLEARLY EST.ABLISH THAT ALLOWING ANIMALS TO <br />DEFECATE ON THE PROPERTIES OF OTHERS CREATES A <br />NUISANCE CONDITION PROSCRIBED BY SECTION 505.08. <br />WHEREAS, the North Olmsted police department has recommended that an <br />appropriate amendment be made to Section 505.08 of the Codified Ordinances of the City <br />of North Olmsted in to establish that even single instances of owners permitting or <br />suffering their pets to defecate upon the properties of others constitutes a nuisance <br />condition; and <br />WHEREAS, this Council accordingly desires to amend Section 505.08 of the <br />Codified Ordinances to accomplish the foregoing, and in addition further desires to create <br />new Section 505.081 of the Codified Ordinances in order to require that dog owners carry <br />materials or implements with them for collecting feces while walking their dogs; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there is hereby created new Section 505.081 of Chapter 505 of <br />the General Offenses Code, which as created shall read as follows: <br />SECTION 505.081. MATERIAL TO REMOVE DOG FECES. <br />(a) No person shall walk, or otherwise have in his or her custody or <br />control, any dog upon any public property, including streets, sidewalks, <br />public parks, parkways and alleys, unless the person has in his or her <br />possession, and in plain view, readily usable materials or implements <br />sufficient to remove and to dispose of lawfully any fecal matter that may <br />be deposited on the ground by the dog. <br />
