CITY OF NORTH OLMSTED '\ I / - <br />RESOLUTION NO. 2004 -128 ' 0 1 <br />BY: Council Members Nashar and Miller <br />WHEREAS, the City of North Olmsted, on January 22, 2001, became the second city in the State of Ohio <br />to adopt legislation banning the use of hand-held cell phones by operators of motor vehicles on roads and tughways <br />located within its territorial limits; and <br />WHEREAS, the Council of the City of North Olmsted believes that enforcement of North Olmsted's local <br />ordinance prohibiting such cell phone use by motor vehicle operators has made the roads and highways located <br />within the City of North Olmsted safer for the motoring public as well as for pedestrians; and <br />WHEREAS, Ohio House Bill 210, which would impose a state-wide ban on the use of hand-held cell <br />phones by operators of motor vehicles on all roads and highways located in the State of Ohio, is presenfly pending in <br />the House Committee on Transportation and Public Safety; and <br />WHEREAS, this Council believes that HB 210, if enacted, would make the roads and highways in the State <br />of Ohio safer for, and would therefor confer a significant benefit upon, the motoring public as well as pedestrians, <br />including residents of the City of North Olmsted; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: T'hat the Council of the City of North Olmsted urges the Ohio General Assembly to adopt <br />House Bi11210 which would ban the use of hand-held cell phones by operators of motor vehicles on the roads and <br />highways of the State of Ohio. <br />SECTION 2: That the Clerk of Council be, and hereby is, directed to forward a copy of this Resolution <br />to Ohio Governor Bob Taft, Oluo Senator Robert F. Spada, and Ohio House Representative Sally Conway Kilbane, <br />and urge all of them to support the adoption of House Bill 210 presently pending in a committee of the General <br />Assembly. The Clerk of Council is further authorized to forward a copy of this Resolution to all cities and villages <br />in Cuyahoga County. <br />A RESOLUTION URGING THE OHIO GENERAL ASSEMBLY TO PASS <br />LEGISLATION BANNING THE USE OF HAND-HELD CELL PHONES BY <br />OPERATORS OF MOTOR VEHICLES ON THE ROADS AND HIGHWAYS OF THE <br />STATE OF OHIO. <br />SECTION 3: Thai this Resolution shall take effect and be in force from and after the earliest period <br />allowed by law. <br />PASSED: <br />First Reading: D ? <br />Second Reading: p <br />Third Reading,I-) & 141/c' i " <br />Committee: <br />ATTEST.• <br />Barbara L.
