t <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004 - 125 <br />BY: Mayor Musial <br />A RESOLUTION APPROVING OF AND AUTHORIZING THE <br />MAYOR TO ENTER INTO A COLLECTIVE BARGAINING <br />AGREEMENT WITH THE AMERICAN FEDERATION OF <br />STATE, COUNTY AND MUNICIPAL EMPLOYEES ("AFSCME'), <br />OHIO COUNCIL 8, LOCAL 2681 FOR THE CITY'S SERVICE <br />UNIT EMPLDYEES, FOR THE PERIOD JULY 1, 2004 <br />THROUGH JUNE 30, 2007 AND DECLARING AN EMERGENCY. <br />WHEREAS, the legislature of the State of Ohio has heretofore adopted legislation <br />calling for collective bargaining agreements with public employees; and <br />tiyhIEREAS, the American Federation of State, County and Municipal Employees <br />("AFSCME"), Ohio Council8, Loca12681, has been recognized as the exclusive bargaining <br />agent for the City's Service Unit employees; and <br />WHEREAS, the Administration has conducted interest-based bargaining this year with <br />the members of said bargaining unit and has concluded that IBB process with an agreement <br />that is satisfactory to the Administration and the bargaining unit; and <br />WHEREAS, it is the desire of this Council to approve of and authorize the Mayor to <br />enter into a collective bargaining agreement AFSCME, Ohio Council8, Loca12681 on behalf <br />of the said Service Unit employees, for the period July 1, 2004 through June 30, 2007; <br />NOW, THEItEFOItE, BE IT RESOL VED BY THE COUIVCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the collective bargaining agreement negotiated by and between the <br />Administration and AFSCME, Ohio Council8, Local 2681, on behalf of the City's Service <br />Unit employees, a copy of which is attached to this legislation as "Exhibit A," is approved and <br />the Mayor is authorized to execute the said Agreement. <br />SECTION 2: That the effective date of any and all wage and other economic benefits <br />provided for in the said Agreement, unless otherwise expressly specified therein, shall be July <br />1, 2004. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of <br />this City and for the further reason that this Resolution is required to be immediately effective <br />in order to guarantee continuity of the services of employees in the Service Department that <br />are vital to the community; and further provided it receives the affirmative vote of two-thirds <br />of all members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />
