AW <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -120 <br />BY: Council Member Nashar <br />AN ORDINANCEAMENDING SECTION 351.11 OF THE TRAFFIC CODE TO <br />PROHIBIT CERTAIN TRUCg PARSING WITHIN RESIDENCE DISTRICTS, AS AMENDED <br />N'HEREAS, at the request of the Board of Zoning and Building Appeals, it is the desire of this Council to <br />clarify the definition of trucks prohibited from parking on residential streets or district; and <br />WHEREAS, it is the desire of this Council to amend the aforesaid North Olmsted Codified Section 351.11 <br />and to exercise local police powers to enhance and protect the public safety and the general welfare of the citizens of <br />North Olmsted; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 351.11 of the General Offenses Code, entifled "Parking of Unauthorized <br />Vehicles in Residential and Business Districts; Impounding," which presenfly reads as follows: <br />"351.11 PARKING OF UNAUTHORIZED VEHICLES 1N RESIDENTIAL AND BUSINESS <br />DISTRICTS; IlviPOUNDING. <br />(a) No person shall park a truck, trailer or semitrailer in a roadway at any time in front of or alongside of <br />property used for residential purposes except in case of a breakdown or for loading or unloading <br />purposes. <br />(b) No person shall park or abandon a truck, trailer or semitrailer or other motor vehicle on private <br />properiy without permission of the owner of the property. Any vehicle which is so parked without the <br />pemrission or authority of the owner of such properiy upon which such motor vehicle is either parked <br />or abandoned may be removed in the same manner as is provided in Section 351.01 and any costs for <br />the removal thereof shall be paid by the owner of such motor vehicle." <br />shall be amended, and, as amended, shall read in its entirety as follows: <br />"351.11 PARKING OF UNAUTHORIZED VEHICLES IN RESIDENTIAL AND BUSINESS <br />DISTRICTS; IlvIPOLTNDING. <br />(a) No person shall park a truck with gross vehicle weight (GVW) of 10,000 pounds or more, <br />commercial tractor, bus, trailer or semitrailer ou any street or roadway, nor the berm or right-of- <br />way thereof, at any time in front of or alongside of property zoned or used for residential purposes ff <br />' except in case of a breakdown or for ' lindted loading or <br />unloading purposes. <br />(b) No person sball park or abandon a truck with gross vehicle weight (GVVV) of 10,000 pounds or <br />more, commercial tractor, bus, trailer or semitrailer ar other motor vehicle on private property <br />without pennission of the owner of the property. Any vehicle which is so parked without the <br />pernussion or authority of the owner of such property upon which such motor vehicle is either parked <br />or abandoned may be removed in the same manner as is provided in Section 351.01 and any costs for <br />the removal thereof shall be paid by the owner of such motor vehicle." <br />SECTION 2: Thai the operation of any Ordinance, or part of any Ordinance in conflict or inconsistent with <br />any provision of this Ordinance is, to the extent of any such conflict or inconsistency, repealed. <br />SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest period <br />allowed by law. <br />
