CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004-113 <br />BY: Mayor Musial. <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL EQUIPMENT <br />EASEMENT LOCATED ON PROPERTY OWNED BYKCHGC, INC., <br />A DELAWARE CORPORATION, AND DESIGNATED AS PERMANENT <br />PARCEL NUMBER 232-25-035 BY CUYAHOGA COUNTY MAPS AND <br />RECORDS, AND DECLARING AN EMERGENCY <br />WHEREAS, KCHGC, Inc., a Delaware Corporation, has offered a Permanent <br />Maintenance Easement for Traffic Control Equipment to the City of North Olmsted, a <br />copy of which is attached as Exhibit I; and <br />WHEREAS, traffic signal loop detectors have been installed in the drive to Tops <br />Market at the intersection of Brookpark Extension and Sparky Lane as part of the Tops <br />Market construction project, the location of which is shown on Exhibit "B" of the <br />easement; and <br />WHEREAS, this Council desires to obtain from said owner a permanent easement <br />for maintenance purposes in order to allow the City access to the loop detectors to install, <br />reinstall or maintain the loop detectors and appurtenances on said property known as <br />Permanent Parcel Number 232-25-035; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLSMTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the <br />City of North Olmsted, a Permanent Maintenance Easement for Traffic Control <br />Equipment from KCHGC, Inc., a Delaware Corporation, the owner of certain real <br />property located on Brookpark Extension and known as Permanent Parcel Number 232- <br />25-035. A copy of said Easement, which the Mayor is authorized to accept on behalf of <br />the City, is attached as Exhibit I and made a part hereof as though fully rewritten herein. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed <br />to cause said easement to be recorded in the Office of the Cuyahoga County Recorder. <br />
