CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -106 <br />BY: Council Member Kasler. <br />AN ORDINANCE CREATING NEW SECTION 109.07 OF <br />CHAPTER 109 OF THE ADMINISTRATIVE CODE, <br />ENTITLED "PUBLIC MEETINGS," IN ORDER TO CLARIFY <br />THE CLERICAL POSITIONS RESPONSIBLE FOR OPEN <br />MEETINGS AND PUBLIC RECORDS FUNCTIONS ARISING <br />OUT OF MEETINGS AND OTHER GOVERNMENTAL <br />ACTIONS OF THE VARIOUS BOARDS AND COMMISSIONS <br />OF THE CITY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Chapter 109 of the Administrative Code, as most recently amended by <br />Ordinance No. 2004-79, adopted by this Council on May 18, 2004, identifies the various clerical <br />positions that are responsible for providing notice to the public and the media of ineetings of the <br />various boards and commissions of the City; and <br />WHEREAS, it is the desire of this Council, in order to ensure compliance with the Open <br />Meeting and Public Records laws, to clarify the clerical positions that are responsible for other <br />open meetings and public records functions arising out of ineetings and other governmental <br />actions of the said boards and commissions; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUIVTY, AND STATE OF OHIO: <br />SECTION 1: That there be, and hereby is, created new Section 109.07 of Chapter 109 of <br />the Administrative Code, which as created shall read as follows: <br />"109.07 OPEN MEETINGS AND PUBLIC RECORDS FUNCTIONS. <br />The Clerk, as defined in Section 109.02(a) of this Chapter, shall be the records <br />custodian for the records of the municipal bodies identified in this Chapter, and further shall <br />provide clerical support, in the manner and to the extent as directed by lus or her appointing <br />authority, for the preparation of the minutes of the meetings of such mumcipal bodies. <br />SECTION 2: That all ordinances, or parts of ordinances, inconsistent or in conflict with <br />this Ordinance, are, to the extent of such inconsistency or conflict, repealed.
