CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -103 <br />BY.• Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 149.02 OF <br />CHAPTER 149 OF THE ADMINISTRATIVE CODE OF THE <br />CITY OF NORTH OLMSTED, ENTITLED "PLANNING <br />COMMISSION" SO AS TO EXPAND NOTIFICATION OF <br />RESIDENTS AND PROPERTY OWNERS FOR REVIEW OF <br />DEVELOPMENT PI,ANS WHICH ALSO INCL UDE <br />REZONING PROPOSALS. <br />WHEREAS, the notification provisions for Planning Commission's review of <br />development plans, including those in which rezoning may be recommended, differ from those <br />notice provisions governing City Council's consideration of rezoning legislation; and <br />WHEREAS, it is in the best interest of the City and its residents to hannonize the <br />notification procedures of Planning Commission and City Council so that the affected residents <br />and property owner are notified whenever Planning Commission consider the initiation of zoning <br />amendments in conjunction with development plan review; and <br />WHEREAS, it is the desire of this Council amend Section 149.02 to provide for <br />notification of residents and property owners when Planning Commission proposes to initiate <br />zoning amendments, so that said notification is consistent with City Council's notification <br />procedure upon hearing any such rezoning proposal; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 149.02 (Chapter 149: Planning Commission) of the <br />Administrative Code, which presently reads: <br />"149.02 NOTICE OF MEETINGS. <br />(a) The secretary of the Planning Commission shall be required to send notification of <br />Planning Commission meetings giving the time, date and subject matter of the meeting to the <br />independent record title holder of property affected by any proposed subdivision or development. <br />For the purposes of this section those interested parties affected by any subdivision or <br />development shall be as follows: <br />(1) Those on the same side of the street which abut the premises involved; <br />(2) Those across the street immediately opposite the premises involved; <br />(3) Any other premises abutting the premises involved; and <br />
