Ordinance No. 2004-102 <br />"Section 1: That there is hereby created a Building and Land Acquisition <br />and Improvement Fund within the Capital Improvements Fund group for <br />the purpose of accounting for the net proceeds received by the City from <br />the sale of the "Old Library" Building located at 27425 Butternut Ridge <br />Road and requiring that monies paid into the said new fund Menies ia <br />said-fuxd may be expended only for acquiring real property, improved or <br />unimproved, for present or future City needs; constructing improvements, <br />including additions to buildings, upon lands owned by the City; or for <br />substantially rehabilitating or renovating existing City-owned buildings. <br />Improvements, rehabilitations, and renovations shall not be construed to <br />include, and monies from this Fund may not be expended for, purchases of <br />furniture and other room or office furnishings, paint, wallcoverings, <br />window treatments, and carpeting or other floor treatments." <br />SECTION 2: That the Clerk of Council shall immediately forward an attested <br />copy of this Ordinance amending Section 1 of Ordinance No. 2003-162 to the Auditor of <br />Cuyahoga County and the Auditor of the State of Ohio. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health, safety and <br />welfare of the City of North Olmsted, Ohio and for the further reason that it is necessary <br />that this Ordinance go into effect immediately so that the proceeds anticipated to be <br />received by the City from the sale of the old Library at the end of the month of June 2004 <br />may be properly recorded in accordance with the direction received from the State <br />Auditor, and further provided that it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: ?First Reading: <br />Second Recrding: <br />Third Reading: <br />? 477 <br />AT T.;`( <br />? <br />ARBARA L.
