CITY OF NORTH OLMSTED ORDINANCE NO. 2004 -100 BY: Mayor Musial AN ORDINANCE AUTHORIZING THE DIRECTOR OF PLANNING TO SOLICIT PROPOSALS FOR SPECIALIZED PLANNING AND DESIGN SERVICES RELATED TO THE CREATION OF DESIGN GUIDELINES AND A STREETSCAPE PLAN FOR THE CITY OF NORTH OLMSTED; FURTHER AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE CONSULTANT SELECTED IN THE RFP PROCESS; AND DECLARING AN EMERGENCY. WHEREAS, it is the desire of this Council, acting pursuant to Sections 111.03 et seq. of the City Administrative Code, to authorize the Director of Planning to request proposals for specialized planning and design services related to the creation of Design Guidelines and a Streetscape Plan for the City of North Olmsted, and further to authorize the Mayor to enter into an agreement with the consultant selected in the RFP process and approved by the Board of Control; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Director of Planning be and she hereby is authorized to request proposals for specialized planning and design services related to the creation of Design Guidelines and a Streetscape Plan for the City of North Olmsted in accordance with the "City of North Olmsted Request for Proposal - Consultant Services for Creation of Design Guidelines and Streetscape Plan, attached to this Ordinance as Exhibit A. SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board of Control, to enter into an Agreement with the consultant selected in the RFP (Request for Proposal) process, and that such Agreement be in a form approved by both the Mayor and the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that it is necessary that this Ordinance go into effect immediately due to the pressing need that the City has to begin the RFP process prior to the beginning of City Council's summer vacation commencing on July 1, and, further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
