CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -100 <br />BY: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PLANNING <br />TO SOLICIT PROPOSALS FOR SPECIALIZED PLANNING AND <br />DESIGN SERVICES RELATED TO THE CREATION OF DESIGN <br />GUIDELINES AND A STREETSCAPE PLAN FOR THE CITY OF <br />NORTH OLMSTED; FURTHER AUTHORIZING THE MAYOR TO <br />ENTER INTO AN AGREEMENT WITH THE CONSULTANT <br />SELECTED IN THE RFP PROCESS; AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, it is the desire of this Council, acting pursuant to Sections 111.03 et <br />seq. of the City Administrative Code, to authorize the Director of Planning to request <br />proposals for specialized planning and design services related to the creation of Design <br />Guidelines and a Streetscape Plan for the City of North Olmsted, and further to authorize <br />the Mayor to enter into an agreement with the consultant selected in the RFP process and <br />approved by the Board of Control; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Director of Planning be and she hereby is authorized to <br />request proposals for specialized planning and design services related to the creation of <br />Design Guidelines and a Streetscape Plan for the City of North Olmsted in accordance <br />with the "City of North Olmsted Request for Proposal - Consultant Services for Creation <br />of Design Guidelines and Streetscape Plan, attached to this Ordinance as Exhibit A. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of <br />the Board of Control, to enter into an Agreement with the consultant selected in the RFP <br />(Request for Proposal) process, and that such Agreement be in a form approved by both <br />the Mayor and the Director of Law. The character of any such changes as not being <br />substantially adverse to the City shall be evidenced conclusively by the execution of the <br />Agreement by the Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and <br />for the further reason that it is necessary that this Ordinance go into effect immediately <br />due to the pressing need that the City has to begin the RFP process prior to the beginning <br />of City Council's summer vacation commencing on July 1, and, further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />
