-1% <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -1 <br />BY: Council Member Gareau <br />AN ORDINANCE CREATING NEW SECTION 137.03 OF <br />CHAPTER 137 OF THE ADMINISTRATIVE CODE, <br />ENTITLED "DEPARTMENT OF LAW," IN ORDER TO <br />AUTHORIZE THE DIRECTOR OF LAW TO SETTLE <br />CERTAIN SMALL DOLLAR CLAIMS OF OR AGAINST THE <br />CITY OF NORTH OLMSTED. <br />WHEREAS, it is the desire of this Council to authorize the Director of Law to settle <br />claims of the City and against the City up to certain specific dollar limits; <br />NOW THEREFORE, BE IT ORDAIIVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Section 137.03 of Chapter 137 of <br />the Administrative Code, entitled "Director of Law," which, as created, shall read in its entirety <br />as follows: <br />"137.03 CLAIMS SETTLEMENT AUTHORIT'Y OF DIRECTOR OF LAW. <br />(a) The Director of Law is authorized to settle any claim presented to or filed against <br />the City, provided the settlement amount does not exceed Two Thousand Dollars or the <br />applicable City insurance deductible, whichever is greater, and further provided that <br />sufficient momes have been appropriated and are available for the payment of the <br />settlement amount. <br />(b) The Director of Law is authorized to prosecute and settle any claim of the City, <br />provided that the Director of Law determmes the claim to have a settlement value of <br />Five Thousand Dollars or less. <br />(c) At least seven (7) days prior to prosecuting any claim authorized by paragraph (b) <br />above, or settling any claim pursuant to either paragraph (a) or (b), the Director of Law <br />shall report in writing to Council stating the nature of the claim which he proposes to <br />prosecute andlor settle, the dollar amount of the proposed settlement, and the reasons in <br />support of the action he proposes to take. <br />SECTION 2: That all ordinances, or parts of ordinances, inconsistent or in conflict with <br />this Ordinance, are, to the extent of such inconsistency or conflict, repealed. <br />
