CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004 -15 <br />BY: Mayor Musial <br />A RESOLUTION AUTHORIZING THE MAYOR, FOLLOWING <br />APPROVAL BY THE BOARD OF CONTROL, TO ENTER INTO <br />AN AGREEMENT WITH LAKE BUSINESS PRODIICTS TO <br />PURCHASE A COPY MACHINE/SERVICE AGREEMENT FOR <br />THE CONGREGATE MEAL PROGRAM OPERATED BY THE <br />NORTH OLMSTED DEPARTMENT OF HUMAN RESOURCES, <br />DIVISION OF AGING, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City has previously entered into intergovernmental agreements to <br />operate the Congregate Meal Program and the Department of Human Resources, Division of <br />Aging continues to provide such services in 2004, with the benefit of Title III C. grant funding, <br />at the multiservice Senior Center; and <br />WHEREAS, in addition to said grant monies awarded to the City, the regulations of <br />the Ohio Department of Aging, specifically the Western Reserve Area Agency on Aging <br />(V;RAAA), provide that donations received by the Congregate Meal Program operate as <br />program income, which may either be set aside for expenditure on such equipment purchases <br />or returned to WRAAA; and <br />WHEREAS, the Director of Human Resources has compared the prices of four (4) <br />vendors for copy equipment/service agreements and recommends this agreement as offering <br />improved printing of agency documents, newsletter, with additional features for fax and direct <br />copy functions which integrate with Department computers, and will replace the current leased <br />equipment; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor, subject to approval <br />by the Board of Control, to enter into an agreement with Lake Business Machines to purchase <br />and service copy equipment for the Congregate Mea1 Program; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That, upon approval of the Board of Control, if necessary, the Mayor be <br />and is hereby authorized to enter into an agreement with Lake Business Machines, Inc., to <br />purchase and then provide service for copy equipment, as specified by and in substantially the <br />same tertns as set forth in "Exhibit A". Said agreement sha11 be in the form of the Agreement <br />attached to this Resolution as "Exhibit A," with only such changes therein as are not <br />substantially adverse to the City and which are approved by both the Mayor and the Director <br />of Law. The character of any such changes as not being substantially adverse to the City sha11 <br />be evidenced conclusively by the execution of the agreement by the Mayor and the approval of <br />the agreement by the Director of Law. <br />
