CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 18 <br />BY: Mayor Musial <br />A ORDINANCE DISPENSING WITH AN RFP PROCESS, <br />AIITHORIZING THE DIRECTOR OF LAW TO RETAIN THE <br />SERVICES OF THE LAW FIRM OF JOHNSON, ANGELO & <br />COLALUCA, L.L. C., AS OUTSIDE COUNSEL TO ASSIST THE <br />DIRECTOR OF LAW IN THE CITY'S CURRENT LABOR <br />NEGOTIATIONS, INCL UDING MEDIATION, FACT-FINDING <br />AND CONCILIATION; FURTHER AUTHORIZING THE MAYOR, <br />FOLLOWING APPROYAL BY THE BOARD OF CONTROL, TO <br />ENTER INTO A CONTRACT WITH SAID LAW FIRM; AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Article V, Section 2 of the Charter provides that the Director of Law, <br />with the approval of City Council, may retain the services of outside counsel to assist him or <br />her in performing any of the duties of his or her office; and <br />WHEREAS, the Director of Law has requested that this Council approve the retention <br />of outside counsel to assist him in the City's current labor negotiations with the City's <br />bargaining units, particularly in mediation, fact-finding and conciliation; and <br />WHEREAS, the Director of Law has reviewed the resumes of labor attorneys and <br />labor law firms on file in the City Law Department and, following said review, recommends the <br />Law Firm of Johnson, Angelo & Colaluca, L.L.C. as the labor law firm he believes is most <br />qualified to provide the City with the necessary outside legal services at a price which is fair <br />and reasonable to the City; and <br />WHEREAS, it is not feasible or practicable to utilize the formal Request for Proposals <br />("RFP") procedure set forth in Sections 111.03 et seq. of the Codified Ordinances to select <br />outside counsel, because of an emergency need to immediately retain counsel to assist in an <br />impending fact-finding hearing with one of the City's bargaining units; and <br />WHEREAS, Section 111.08(A)(3) of the City's Codified Ordinances further provides <br />that renewal agreements with professionals with whom the City has a continuing relationship <br />may be renewed without employing an RFP process, and the City, in the year 2002, previously <br />retained the services of Johnson, Angelo & Colaluca to assist the Director of Law in 2002 <br />labor negotiations; and <br />WHEREAS, it is accordingly the desire of this Council to approve the retention of <br />outside counsel to assist the Director of Law in the current labor negotiations and authorize <br />the Mayor, subject to approval by the Board of Control, to enter into an agreement with the <br />Law Firm of Johnson, Angelo & Colaluca, L.L.C. to provide said outside legal services as <br />recommended by the Director of Law;
