<br />17.4 Any employee under indictment or arrested for a felony shall be placed an leave of <br />absence without pay until resolution ofthe court proceedings. An employee may use accrued <br />vacation, holiday, or persona.l time during the leave. An employee found guilty by the tria.l court <br />may be discharged. An employee found innocent of the charges shall be paid for all lost time and <br />shall have any vacation, holida.y, or personal time restored to his credit. In addition, all expected <br />cost or premium cost of hospitalization benefits paid by such employee shall be reimbursed less <br />amount of employee co-payment required per Article 12. The Employer sha.ll, during the period <br />for which the employee is utilizing vacation, hoiidays or personal time, continue to pay the <br />employee's insurance premiurns during the leave of absence. <br />Upon exhausting vacation, Holidays and Persona.l time, said employee will be required to <br />pay the Director of Finance ( 100%) of ail expected cost or premium cost for the purpose qf <br />continuing hospitalization benefits during the balance of the leave of absence. <br />A.RTICLE 18 <br />LEGALITY <br />18.1 It is the intent of the City and tlle F.O.P. that this Agreement comply in every <br />respect with applicable legal statutes and charter requirements. If it is deterniirzed that any, <br />provisions of this Agreement are in conflict with any court of competent jurisdiction, that <br />provision shall be null and void and shall not affect the validity of the remazning paragraphs of <br />this Agreement. <br />18.2 Any past understanding, ordinance or resolution which has been in effect shall <br />remain in effect until such time that it is modified by a subsequent agreement. Such <br />modification shall be completed by the procedures set up in this Agreement for negotiations. <br />34
