<br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 39 <br />BY: Council Members Gareau and Limpert. <br />AN ORDINANCE PROVIDING FOR THE AMENDMENT OF <br />THE ZONE MAP OF THE CITY OF NORTH OLMSTED BY <br />REZONING THE REAR (NORTfO PORTION OF PERMANENT <br />PARCEL NOS. 232-34-011, 232-34-012, 232-34-013, 232-34-014 <br />AND 232-34-01 S, LOCATED AT 25600 LORAIN ROAD FROMB <br />RESIDENCE SINGLE FAMILY TO GENERAL RETAIL <br />BUSINESS. <br />WHEREAS, this Council, upon the recommendation and review of the City Planner, finds <br />that rezoning the rear (north) portion of Permanent Parcel Nos. 232-34-011, 232-34-012, 232-34- <br />013, 232-34-014 and 232-34-015, from B residence single family district use to general retail business <br />district use will further, and bears a substantial relation to, the public health, safety, and welfare, and <br />that said rezoning will promote orderly development of a good general retail business use on these <br />parcels of land; and <br />WHEREAS, on the 27th day of January, 2004, by formal motion, the Planning Commission <br />recommended the initiation of this Ordinance, proposing to rezone the rear (north) portion of <br />Permanent Parcel Nos. 232-34-011, 232-34-012, 232-34-013, 232-34-014 and 232-34-015 from B <br />residence single family district use to general retail business district use; and <br />WHEREAS, following publication of newspaper notice and notice to the record title holders <br />of real property located within one thousand (1,000) feet of the property proposed to be rezoned, a <br />public hearing was held, in conformance with the provisions of S ion 14 of Article N of the Charter <br />and Section 1127.03 of the Zoning Code, on the o10 day of 2004; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECT'ION 1: That the Zone Map of North Olmsted is hereby amended, and, as amended, <br />shall depict and state that the zoning of the following parcels of land located within the City, to-wit: <br />Permanent Parcel Nos. 232-34-011, 232-34-012, 232-34-013, 232-34-014 and 232-34-015, located <br />at 25600 Lorain Road, North Olmsted, Ohio, shall be, in their entirety zoned for general retail <br />business district use. A true and accurate copy of the legal description for said parcels, as well as a <br />map depicting the parcels, is attached to this Ordinance as, respectively, Exhibits "A" and "B." <br />I
