? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 42 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE <br />NO. 99-107 WHICH ESTABLISHED THE SAFE TRAFFIC <br />ORIENTED POLICING ("STOP'), IN ORDER TO PROVIDE <br />THAT A PORTION OF THE CITY PROSECUTOR'S SALARY <br />MAYBE PAID FROM "STOP" FUNDS. <br />WHEREAS, the duties of the City Prosecutor have substantially increased following the <br />implementation of the City's STOP program in 1999; and <br />WHEREAS, the compensation rate established by this Council in 2002 for the City <br />Prosecutor, at the recommendation of the new Director of Law, did not sufficiently taken into <br />account the increased hours that the City Prosecutor must devote to cases in Rocky River <br />Municipal Court as a result of the number of cases prosecuted in that Court arising out of the <br />STOP program; and <br />N'HEREAS, it is the desire of this Council to equitably adjust the compensation paid to <br />the City Prosecutor in light of the increased duties he has been performing for the past two years, <br />without additional compensation, in prosecuting STOP violations; and <br />WHEIlEAS, this Council believes that it is appropriate that the compensation adjustment <br />it makes be made from STOP funds, rather than from the General Fund; and <br />WHEREAS, it is accordingly the desire of this Council to amend Section 2 of Ordinance <br />No. 99-107 to authorize that monies in the STOP Special Revenue Fund may to be used for <br />payment of a portion of the City Prosecutor's salary, but not to exceed the percentage amount <br />attributable to the number of STOP cases prosecuted in the Rocky River Municipal Court; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 2 of Ordinance No. 99-107, which presently reads as follows: <br />"Section 2: That there is hereby established a separate Special Revenue <br />Fund for the Safe Traffic Oriented Policing ("STOP") program. The Director of <br />Finance is hereby directed to receive and pay into said separate fund a11 fines and <br />costs receiveci hy the City from Rocky River Municipal Court as a result of the <br />disposition of traffic citations issued by police officers while on STOP duty.
