CITY OF NORTH OLMSTED ORDINANCE NO. 2004 - 46 BY: Mayor Musial AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO A CANCELLA TION AND TERMINATION OF LEASE AGREEMENT WITH THE BOARD OF TRUSTEES OF THE CUYAHOGA COUNTY PIIBLIC LIBRARY FOR THE PURPOSE OF TERMINATING THE LIBRARY'S LEASE AT THE SITE OF THE OLD NORTH OLMSTED LIBRARY BUILDING LOCATED AT 27425 BUTTERNUT RIDGE ROAD, AND DECLARING AN EMERGENCY. WHEREAS, the Cuyahoga County Public Library is preparing to move from the site of the old North Olmsted Library Building located at 27425 Butternut Ridge Road and into the new North Olmsted Library Building located at 27403 Lorain Road; and WHEREAS, it is the desire of this Council to authorize the Mayor to terminate the City's Lease Agreement with the Board of Trustees of the Cuyahoga County Public Library relating to the property known as the old Library Building located at 27425Butternut Ridge Road, so that the City and the Cuyahoga County Public Library may enter into a new lease agreement relating to the real property which will be the site of the new North Olmsted Library at 27403 Lorain Road; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into a Cancellation and Termination of Lease Agreement with the Board of Trustees of the Cuyahoga County Public Library for the purpose of terminating the Lease between the City and the Cuyahoga County Public Library relating to the real property known as the old North Olmsted Library Building located at 27425 Butternut Ridge Road. Said Cancellation and Termination of Lease Agreement shall be in the form and substance of the attached Cancellation and Termination of Lease Agreement (Existing Facility 27425 Butternut Ridge Road) between the City of North Olmsted and the Boaxd of Trustees of the Cuyahoga County Public Library, marked as Exhibit A and attached hereto, with only such changes to be hereinafter made as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Lease Agreement by the Mayor and its approval by the Director of Law. 5ECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the reason that it is necessary that this Ordinance go into effect immediately because the Library is moving from the old Library Building to the new Library Building on or about April 8, 2004, and the termination of lease must be in effect on or before the date of such move, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
