,. . . ? .,.? . ..... , .,? . , . ..s,,. u t.? .a- , .. , .. _ _ . ; .W EXHIBIT "A" CANCELLATION AND TERMINATION OF LEASE AGREEMENT (Existieg Facility 27425 Butternut Ridge Road) BETWEEN THE CITY OF NORTH OLMSTED AND THE BOARD OF TRUSTEES OF THE CUYAHOGA COUNTY PUBLIC LIBRARY This CANCELLATION AND TERMINATION OF LEASE AGREEMENT is executed this day of , 2004 by and between the CITY OF NORTH OLMSTED, an Ohio Municipal corporation, located at 5200 Dover Center Road, North Olmsted, Ohio 44070, as Lessor, (hereinafter called the "City") and the BOARD OF TRUSTEES OF THE CLJYAHOGA COLJNTY PUBLIC LIBRARY, located at 2111 Snow Road, Parma, Ohio, 44134, as Lessee (hereinafter called the "Trustees"). WITNESSETH: WHEREAS, on or about September 1, 1965, the City and the Trustees entered into a Lease Agreement for the lease of a facility, as a free public library, located at 27425 Butternut Ridge Road, North Olmsted, Ohio (hereinafter called the "Existing Facility"), for a term of years and thereafter until the Lease is terminated by mutual agreement; and WHEREAS, the Trustees have operated, as a free public library, a Branch of the Cuyahoga County Public Library (the North Olmsted Branch) in said Existing Facility; and WBEREAS, the City Council submitted to the electors of the City at an election held in November 2000 on the question of, and those electors approved, the issuance of general obligation bonds, in the aggregate principal amount of $10,750,000.00 (the "Obligations"), for the purpose of constructing, furnishing and equipping a new public library building (the "New Building") and improving access thereto and the site thereof located at 27403 Lorain Road,
