<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 47 <br />BY: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO A LEASE AGREEMENT WITH THE BOARD <br />OF TRUSTEES OF THE CUYAHOGA COUNTY PUBLIC LIBRARY FOR <br />THE PURPOSE OF OPERATING A FREE PUBLIC LIBRARY AT THE <br />SITE OF THE NEW NORTH OLMS7'ED LIBRARY BUILDING LOCATED <br />AT 27403 LORAIN ROAD, AND DECLARING AN EMERGENCY. <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a Lease <br />Agreement with the Board of Trustees of the Cuyahoga County Public Library for the purpose of <br />operating a free public library at the site of the new North Olmsted Library Building located at <br />27403 Lorain Road; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a Lease <br />Agreement with the Board of Trustees of the Cuyahoga County Public Library for the purpose of <br />operating a free public library at the site of the new North Olmsted Library Building located at <br />27403 Lorain Road. Said Lease Agreement shall be in the form and substance of the attached <br />Lease Agreement between the City of North Olmsted and the Board of Trustees of the Cuyahoga <br />County Public Library, marked as Exhibit A and attached hereto, with only such changes to be <br />hereinafter made as are not substantially adverse to the City and which are approved by the <br />Director of Law. The character of any such changes as not being substantially adverse to the <br />City shall be evidenced conclusively by the execution of the Lease Agreement by the Mayor and <br />its approval by the Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that it is necessary that this Ordinance go into effect immediately because the Library is <br />moving from the old Library Building to the new Library Building on or about April 8, 2004, <br />and this lease must be in effect prior to such move, and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />1 <br />a <br />PASSED: <br />First Reading: <br />Second Reading. <br />Third Readin <br />Committee: <br />
