OS AND 1101. 09 OF <br />CHAPTER 1101 OF THE PLANNING AND ZONING CODE <br />ENTITLED "SUBDIVISION REGULATIONS" TO INCREASE THE <br />DEPOSIT AMOUNT FOR THE REVIEW AND RECORDING OF <br />MAJOR AND MINOR SUBDIVISIDN PLATS, EASEMENTS, <br />PRELIMINARY PLANS, TOPOGRAPHIC MAPS AND OTHER DATA <br />SUBMITTED TO THE CITYENGINEER <br />WHEREAS, due to the increase in recording fees resulting from State action, it is <br />necessary to revise the deposit amount for the recording of major and minor subdivision <br />plats and easements and for the review of the preliminary plans, topographic maps and <br />plats and other data submitted to the City Engineer; <br />WHEREAS, this Council accordingly desires to amend Sections 1101.05 and <br />1101.09 of the Codified Ordinances to accomplish the foregoing; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1101.05 of Chapter 1101 of the Planning and Zoning <br />Code, which presently reads as follows: <br />1101.05 RECORDING AND REVIEW FEES FOR MAJOR SUBDIVISIONS. <br />(a) A deposit shall be posted with the City by the developer for the <br />recording of subdivision plats, easements, etc., the review of the preliminary plan, <br />topographic map, plat and, if the improvements are to be completed by the developer, <br />improvement plans and specifications before the matter is referred to the Engineer or <br />Law Director. The cost of review shall be calculated on the basis of thirty-five dollars <br />($35.00) per hour spent by the City Engineer's Office and fifty-fve dollars ($55.00) per <br />hour spent by the City Engineer and the Assistant City Engineer for such review. If the <br />deposit is more than the actual cost of review, the remainder shall be refunded. If the <br />cost of recording and review is greater than the deposit, the deficient amount shall be paid <br />to the City before Council approval is given. <br />(b) The filing of the final plat for recording with the County Recorder shall <br />be done by the City Engineer who shall turn such plat over to a reputable title insurance <br />company and request a"Statement on Streets" for the benefit of the City and when such <br />"Statement on Streets" is finished, the Engineer shall order the plat to be recorded. All <br />costs charged for the "Statement on Streets" and recording shall be paid for by the <br />developer. <br />
