,e :. <br />16-:. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 53 <br />BY: Councilman Dailey <br />AN ORDINANCE AMENDING SECTION 505.08 OF CHAPTER 505 <br />OF THE GENE.RAL OFFENSES CODE ENTITLED "ANIMALS <br />AND FOR'L," IN ORDER TO PROHIBIT NOXIOUS OR <br />OFFENSIYE ODORS OR UNSANITARY CONDITIONS THAT <br />CREATE A NUISANCE, INJURIOUS TO THE HEALTH, SAFETY <br />AND PUBLIC WELFARE, AND DECLARING AN EMERGENCY, AS <br />AMENDED. <br />WHEREAS, in the context of keeping and maintaining household pets, Council <br />seeks to prohibit unsanitary conditions which create noxious or offensive odors that <br />create a nuisance and jeopardize the health, safety and the public welfare; and <br />WHEREAS, this Council accordingly desires to amend Section 505.08 of the <br />Codified Ordinances to accomplish the foregoing; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />5ECTION 1: That Section 505.08 of Chapter 505 of the General Offenses Code, <br />which presently reads as follows: <br />505.08 NCTISANCE CONDITIONS PROHIBITED. <br />(a) No person shall keep or harbor any animal in the City so as to permit or <br />suffer to be permitted the commission or evidence of a nuisance as hereinafter defined. <br />(b) Any animal which disturbs the peace and quiet, endangers the repose or <br />heaith of any person or persons, or causes property damage, m any one of the following <br />manners is hereby declared to be a nuisance: <br />(1) By frequently or habitually making loud and <br />offensive noises, including, but not limited to barking, howling, <br />hissing, crying, screaming, screeching, or yelping; <br />(2) By frequently or habituatly scratching or digging in, <br />or urinating or defecating upon, any lawn, tree, shrub, plant, <br />building or any other property, public or pnvate, other than the <br />property of the owner or person in charge or control of such <br />animal, thereby causing damage to said lawn, tree, shrub, plant or <br />building; or <br />(3) On any occasion, when the animal is found on the <br />property of another or upon public property, and is, in an <br />aggressive manner, threatemng to attack, or ttas attacked, any <br />human being. <br />i
