<br />.,?e+,•... <br />Ordinance No. 2004-53 <br />Page 3 <br />(d) In the case of defecation, nogious or offensive odors or unsanitary <br />conditions, wherein the owner or person in chaxge or control of such animal, removes all <br />feces deposited by such animal and disposes of the same in a sanitary manner, such <br />nuisance shall be considered abated. <br />(e) If upon complaint by the person or police officer as provided in paragraph <br />(c) above, the owner, harborer or keeper of the animal cannot be immediately determmed, <br />the Animal Warden may seize and impound the animal. Thereafter, the animal shall be <br />kept and disposed of as provided for in Section 505.02. <br />(fl Whoever violates this section shall be guilty of a minor misdemeanor. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the reason that it is necessary that this Ordinance go into effect <br />immediately in order to address potential nuisance conditions in the Spring season, <br />it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor <br />? <br />PASSED: <br />A <br />BAkBARA L.
