I .f <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 57 <br />BY: Council Member Gareau <br />AN ORDINANCE REPEALING ORDINANCE NO. 2004-17 <br />AND AMENDING SECTION 111.02 OF CHAPTER 111 OF <br />THE ADMINISTRATIVE CODE, ENTITLED "CITY <br />CONTRACTS" IN ORDER TO REQUIRE THE CITY'S <br />CONTRACTORS TO DISCLOSE INFORMATION RELATING <br />TO PAST LITIGATION INVOLVING CLAIMS BY OR <br />AGAINST THE CONTRACTOR, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, this Council believes that, in selecting contractors for the City's <br />competitively bid contracts involving improvements to the City's buildings, streets and rights-of- <br />way, it is important and relevant to acquire and review information relating to civil actions, <br />arbitration demands, and liens filed by or against such contractors; and <br />WHEREAS, it is the desire of this Council to accordingly amend Section 111.02 of <br />Chapter 111 of the Administrative Code, entitled "City Contracts," in order to require City <br />Contractors to disclose, in addition to other relevant information presently required by the said <br />section, specific information relating to such litigation-related history of contractors; and <br />WHEREAS, this Council, on March 3, 2004, adopted Ordinance No. 2004-17, which has <br />already gone into effect as emergency legislation, providing for such amendment to said Section <br />111.02, but questions have arisen as whether said legislation was properly reviewed by committee <br />as required by Council's rules prior to its adoption; and <br />N'HEREAS, it is accordingly this Council's desire, based upon the recommendation of <br />the Director of Law, to repeal Ordinance No. 2004-17 and re-enact the desired amendment of said <br />Section 111.02 in the within legislation; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Ordinance No. 2004-17 is hereby repealed effective the same date as <br />the within legislation becomes effective. <br />5ECTION 2: That Section 111.02 of Chapter 111 of the Administrative Code, entitled <br />"City Contracts," which presently reads as follows: <br />"111.02 MANDATORY MINIMUM CONTRACTING STANDARDS RELATING <br />TO BIDDER RESPONSIBILITY. <br />
