CITY OF NORTH OLMSTED ORDINANCE NO. 2004 - 6 BY: Mayor Musial AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO RENEW THE AGREEMENT BETWEEN THE CITY AND KARRIE SKALL TIPTON FOR THE PROVISION OF PROFESSIONAL GYMNASTICS INSTRUCTION SERVICES AT THE NORTH OLMSTED RECREATION CENTER FOR TWO (2) YEARS AND DECLARING AN EMERGENCY WHEREAS, the City and Karrie Skall Tipton have been parties to a Contract, wherein Tipton has provided gymnastics program services at the City's Recreation Center; and WHEREAS, it is the recommendation of the Director of Public Safety that the Contract between the City and Tipton be renewed and amended to extend the term for two (2) years and to address the revenue sharing provisions; and WHEREAS, it is the desire of this Council to approve and authorize the Contract, in substantially the form as attached hereto, and to apply it retroactively to the date of September 1, 2003, upon the conclusion of the previous agreement and to authorize the Mayor to enter into said Contract; and NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into a Contract with Karrie Skall Tipton in substantially the form and substance as evidenced in the Contract Authorization for the Provision of Gymnastic Equipment, Instructions and Related Services to the City of North Olmsted, attached to this Ordinance as "Exhibit A." Said Contract shall be effective retroactively to September 1, 2003 and continuing through August 31, 2005. SECTION 2: The City shall pay to the Instructor Fifty (50%) percent of all proceeds from the first One Thousand ($1,000.00) Dollars collected from instructional programming, Sixty (60%) percent of all proceeds between One Thousand ($1,000.00) Dollars and Three Thousand ($3,000.00) Dollars collected and Eighty (80%) percent of all proceeds above Three Thousand ($3,000.00) Dollars collected.
