existing, established or scheduled gymnastic programs, which may vary or expand from time to time. 3. Instructor shall be responsible for maintaining the inventory of all gymnastics equipment, as identified in Schedule A, except as herein provided, as located on the second floor gym area, and Instructor shall reasonably determine, from time to time, whether new equipment is needed in order to maintain the facility as a state of the art facility. Instructor shall notify the City of any new equipment purchases and shall also notify the City if any equipment listed on Schedule A is removed from service and/or is replaced. Instructor shall be responsible for supplying all such necessary equipment, the purchasing thereof, and paying for said equipment in full. Except however, that the City and the Instructor shall continue to share ownership of the spring board floor exercise equipment and the City shall share the cost and responsibility for its maintenance and/or replacement on an equal basis, as provided below. 9. Obtain approval from the City's Recreation Commission prior to making changes, alterations, improvements, or additions to the second (2nd) floor gym area. All such improvements or alterations are fixtures, and shall remain property of the City. 10. Insure that a11 areas of the gym and the equipment are inspected and certified in writing on an annual basis by qualified personnel and immediately provide written notification of said inspection results to the City. The Instructor shall take immediate remedial action and report to the City. 11. Obtain and maintain general sports liability insurance for gymnastic instruction activities with policy limits of one million/two million and which names the City of North Olmsted as "an additional Insured" party and provides the City with notice of cancellation. The City shall: 1. Make the second (2°d) floor gym area available for Instructor's programs during hours approved by the City. The City will be entirely responsible £or maintenance of and any improvements to the building and its facility, with the exception of gymnastics equipment owned or acquired by the Instructor, but including the floor exercise equipment as provided herein. The City and the Instructor shall continue to maintain co-ownership of the floor exercise equipment and the City shall, at the direction of and under the supervision of the Instructor, perform necessary maintenance on the floor exercise equipment, as needed, but not more than three (3) times per year. The Instructor is required to request such maintenance, in a writing, through the Recrea.tion Commissioner, with copy to the Maintenance Foreman, in advance. The City may select a date to schedule such maintenance, upon evaluation of such dates and times as staffing requirements pernut, and in consideration of the activities schedule. The Instructor is required to supply the appropriate cleaning and taping materials, which expenses shall be reimbursed by the City in an amount not exceeding Two Hundred ($200.00) Dollars per scheduled maintenance, not more than Six Hundred ($600.00) Dollars per year.
