<br />existing, established or scheduled gymnastic programs, which may vary or <br />expand from time to time. <br />3. Instructor shall be responsible for maintaining the inventory of all gymnastics <br />equipment, as identified in Schedule A, except as herein provided, as located <br />on the second floor gym area, and Instructor shall reasonably determine, from <br />time to time, whether new equipment is needed in order to maintain the <br />facility as a state of the art facility. Instructor shall notify the City of any new <br />equipment purchases and shall also notify the City if any equipment listed on <br />Schedule A is removed from service and/or is replaced. Instructor shall be <br />responsible for supplying all such necessary equipment, the purchasing <br />thereof, and paying for said equipment in full. Except however, that the City <br />and the Instructor shall continue to share ownership of the spring board floor <br />exercise equipment and the City shall share the cost and responsibility for its <br />maintenance and/or replacement on an equal basis, as provided below. <br />9. Obtain approval from the City's Recreation Commission prior to making <br />changes, alterations, improvements, or additions to the second (2nd) floor gym <br />area. All such improvements or alterations are fixtures, and shall remain <br />property of the City. <br />10. Insure that a11 areas of the gym and the equipment are inspected and certified <br />in writing on an annual basis by qualified personnel and immediately provide <br />written notification of said inspection results to the City. The Instructor shall <br />take immediate remedial action and report to the City. <br />11. Obtain and maintain general sports liability insurance for gymnastic <br />instruction activities with policy limits of one million/two million and which <br />names the City of North Olmsted as "an additional Insured" party and <br />provides the City with notice of cancellation. <br />The City shall: <br />1. Make the second (2°d) floor gym area available for Instructor's programs <br />during hours approved by the City. The City will be entirely responsible £or <br />maintenance of and any improvements to the building and its facility, with the <br />exception of gymnastics equipment owned or acquired by the Instructor, but <br />including the floor exercise equipment as provided herein. <br />The City and the Instructor shall continue to maintain co-ownership of the <br />floor exercise equipment and the City shall, at the direction of and under the <br />supervision of the Instructor, perform necessary maintenance on the floor <br />exercise equipment, as needed, but not more than three (3) times per year. The <br />Instructor is required to request such maintenance, in a writing, through the <br />Recrea.tion Commissioner, with copy to the Maintenance Foreman, in advance. <br />The City may select a date to schedule such maintenance, upon evaluation of <br />such dates and times as staffing requirements pernut, and in consideration of <br />the activities schedule. The Instructor is required to supply the appropriate <br />cleaning and taping materials, which expenses shall be reimbursed by the City <br />in an amount not exceeding Two Hundred ($200.00) Dollars per scheduled <br />maintenance, not more than Six Hundred ($600.00) Dollars per year.
