<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 60 <br />BY: Council Member Kasler <br />AN ORDINANCE AMENDING SECTION 137.01 (COMPOSITlO119 OF <br />CHAPTER 137, ENTITLED "DEPARTMENT OF LAW ' OF THE <br />ADMINISTRATIYE CODE, IN ORDER TO PROVIDE FOR A SECOND <br />LAW CLERK POSITION IN THE LAW DEPARTMENT <br />N'HEREAS, the Director of Law has requested that Council create a new law clerk <br />position in the City Law Department in order to more efficiently and economically provide for <br />the delivery of legal services to the Mayor, Council, administrative officials, and the boards and <br />commissions of the City; and <br />WHEREAS, it is the desire of this Council to provide for efficient and economic delivery <br />of legal services within the Law Department, as requested by the Director of Law, by providing <br />for a second law clerk in the Law Department; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />5ECTION 1: That Sectian 137.01 of the Administrative Code, which cunently reads as <br />follows: <br />"137.01 COMPOSITION <br />(a) The Law Department of the City, as provided for in Article V, Section 2 of the City <br />Charter, sha11 be headed by the Director of Law. The employees of the Department shall consist <br />of two assistant directors of Iaw, a legal secretary and a law clerk, all of who shall be appointed <br />by the Director of Law. Each of the assistant directvrs of law shall be an attorney in good <br />standing with the Ohio Supreme Court and licensed to practice law in the State of Ohio. The law <br />clerk shall be a law student at an accredited law school, or a graduate from an accredited law <br />school. <br />(b) One assistant director of law shall be known as the Assistant Director of Law. This <br />shall be a full-time position. The Assistant Director of Law shall prima.rily assist the Director of <br />Law in the performance of his duties, and shall also, when necessary as determined by the <br />Director of Law, assist the City Prosecutor. <br />(c) The other assistant director of law shall be known as the City Prosecutor. This shall <br />be a parttime position. The City Prasecutor shall act on behalf of the City or the State of Ohio <br />in the prosecution of felony and misdemeanor offenses occurring in the City of North Olmsted, <br />and shall perform such other duties as are required by law of municipal prosecutors. <br />(d) The Legal Secretary shall be a full-time position and shall be considered the secretary <br />to the Director of Law. <br />(e) The City Law Clerk sha.ll assist the Director of Law, and shall be paid on an hourly <br />basis." <br />11 -1 . - 7
