CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 61 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTION 955.02 OF CHAPTER 955 SALE <br />OF SURPLUS PERSONAL PROPERTY OF THE CODIF7ED ORDINANCES <br />OF THE CITY OF NORTH OL111STED REGARDING THE PROCEDURE <br />FOR SALE OF SURPLUS PROPERTY TO INCLUDE AUTHORIZATION <br />TO AUCTION SURPLUS PROPERTY AT ELECTRONIC AUCTION <br />WEBSITES. <br />WKEREAS, it is the desire of this Council to amend Section 955.02 of the Codified <br />Ordinances of the City of North Olmsted regarding the procedure for sale of surplus personal <br />property to authorize such property be auctioned at electronic auction websites in order to find a <br />greater market for a variety of items and expose our products to more potential bidders as <br />opposed to a small gathering at a live auction; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, Ci7YAHOGA CDUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 955.02, which currently reads as follows: <br />"955.02 PROCEDURE FOR SALE. <br />(a) Upon determining that an item of surplus property should be sold, the Director <br />shall determine, using available valuation resources, including, for example, blue or red books, <br />the fair market value of the item of property. If the Director determines that the item of property <br />has a fair market value of less than One Thousand Five Hundred ($1,500) Dollars, then the <br />Director may solicit offers to purchase the property employing any commercially reasonable <br />method for soliciting offers, or the Director may dispose of the property at a public auction. <br />(b) If the Director elects to solicit offers for the property, the Director shall sell the <br />property to the highest offeror, and in no event sha11 the property be sold for less than three- <br />fourths of its determined fair market value. Prior to entering into a contract to sell the property, <br />the Director shall submit the proposal to the Board of Control who shall, within ten days, meet <br />and, upon review, either approve or reject the proposed sale. In the event the Board rejects the <br />proposed sale, it shall publicly state its reasons for so doing. <br />(c) if the Director elects to dispose of the property at a public auction, the Director <br />shall first obtain the approval of the Board of Control prior to disposing of the property by this <br />method. <br />(d) If an item of surplus property is determined to have a fair market value in excess <br />of one thousand five hundred dollars ($1,500), then Council shall designate, by ordinance, a <br />commercially reasonable method for soliciting offers for the purchase of the property, and <br />authorize the sale of the surplus property by that method." <br />Be, and hereby is amended, as follows: <br />"(a) Upon determining that an item of surplus property should be sold, the Director <br />shall determine, using available valuation resources, including, for example, blue or red books, <br />
