Section 15.08 Progressive discipline for chargeable accidents, within an eighteen (18) month period, <br />shall be applied as follows: <br />First Chargeable Warning Letter <br />Second Chargeable One (1) to Five (5) Day suspension with possible retraining. <br />Third Chargeable Thirty (30) Day suspension or discharge. <br />Fourth Chargeable Discharge <br />Management reserves the right to waive the above disciplinary action called for, based on the degree <br />of seriousness of the accident, upon investigation. <br />Section 15.09 The Employer shall provide to the Union a copy of all written disciplinary actions <br />against members of bargaining unit. <br />ARTICLE 16 <br />GRIEVANCE PROCEDURE <br />Section 16.01 Every non-probationary full-time employee and the AFSCME Local 3517, NOMBL <br />shall have the right to present a grievance in accordance with the procedures provided herein, free from <br />any interference, coercion, restraint, discrimination or reprisal. A Union representative shall have the <br />right to be present at all stages of the Grievance Procedure. It is the intent and purpose of the parties to <br />this Agreement that all grievances shall be settled, if possible, at the lowest step of this procedure. <br />Section 16.02 For the purposes of this procedure, the terms listed below are defined as <br />follows: <br />(a) Grievance - A°grievance" shall be defined as a dispute or controversy arising <br />from the misapplication or misinterpretation by the City of this Agreement, or the <br />misapplication or misinterpretation by the City of any work rule. <br />(b) Aggrieved Pa.rty - The "aggrieved party" shall be defined as only an employee or <br />group of employees within the bargaining unit actually filing a grievance. <br />(c) Day - A"day" as used in this procedure shall mean calendar days, excluding <br />Saturday, Sundays or Holidays as provided for in this Agreement. <br />(d) Class Grievance - A Class Grievance is defined to mean a grievance presented by <br />AFSCME Local 3517, NOMBL when involving a grievance issue affecting two (2) or <br />more non-probationary employees in the same way. <br />Section 16.03 The following proceiures shall apply to the handling of all grievanc:es filed <br />under this procedures. <br />(a) All decisions shall be rendered in writing at each step of the grievance procedure. <br />Each decision shall be transmitted to the aggrieved party and the Union's representative. <br />(b) Research and preparation of grievance filed by the Union shall be conducted during <br />non-work hours where practicable. Grievance meeting held with the appropriate <br />Employer representatives shail be during the normal City business day (8:30 AM <br />to 430 PM). Any Union representative who had been scherluled to work when the <br />grievance meetings are held will be rescheduled to meet current work <br />schedules. The aggrieved party shall have the right to no more than two (2) <br />representatives: one (1) steward and one (1) representative ofhis cla5sification.
