For as long as CBS, Inc. is obligated to maintain and support the ICES Mobile Software under this Agreement, CBS, Inc. shall respond to customer's request for assistance within eight (8) working hours (Monday through Friday, 8:30 a.m. to 5:00 p.m. EST, holidays excluded) after such request is made. Additionally, CBS, Inc. shall use its best effort to cause the ICES Mobile Software to operate substantially in accordance with its specifications. The Maintenance fee will be invoiced separately, each expiring on the respective anniversary date. (See Attachment A) HARDWARE WARRANTY Compuhensive Business Solutions, Inc. has chosen Compaq as the manufacturer and supplier of the Portable Digital Assistants (PDA's). CBS, Inc. will serve as the channel from customer to the manufacturer. We are not directly or indirectly responsible for damaged or malfunctioning equipment, the manufacturer is ultimately responsible for their product during the warranty period. Compuhensive Business Solutions will, as a part of the Maintenance Agreement, pick the damaged hardware up from the custorner site and contact Compaq for assistance / resolution. In the event the equipment requires to be sent to the manufacturer, CBS will pay all shipping and handling costs associated with the return of eqnipment. Customer will be billed for all actual costs to repair the hardware. Receipts will be provided as support of the invoiced amount. Maintenance Services relating to hardware will only be available while manufacturer warranty is in place. Compaq provides a one-year mail-in warranty on their PDA devices. Compaq offers an extended three-year warranty that can be purchased directly from the manufacturer by the customer. It is NOT the responsibility of CBS, Inc. to apply for the product warranty or track warranty expiration. We will provide to the customer with the Compaq warranty cards date of purchase and serial number. Customer will be responsible in completing the warranty card and submit to manufacturer.
