<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 67 <br />BY: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE MAYOR TO EIVTER INTO A <br />CONTRACT WITH B&C COMMUNICATIONS, INC. TO MAINTAIN BASE <br />RADIOS AND CONSOLE AS WELL AS MOBILE IN-CAR RADIOS FOR <br />THE POLICE DEPARTMENT, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City entered into an Agreement with B&C Communications, Inc. <br />(herein B&C, Inc.) on April l, 2001 to service and repair base radios and console as well as <br />mobile in-car radios for efficient operations in the Police Department; and <br />WHEREAS, the City depends upon B&C, Inc. as an authorized Motorola service and <br />repair company, for its Motorola base radios and console as well as mobile in-car radios for the <br />Police Department; and <br />WHEREAS, due to the knowledge and expertise of contractor, as well as licensing <br />constraints, it is not economical or efficient to solicit these radio maintenance services for the <br />Police Department through other contractors; and <br />WHEREAS, it is the desire of this Council, based upon the recommendations of the <br />Police Chief, to authorize the Mayor to enter into a maintenance services contract with B&C, <br />Inc. to continue to provide service and repair of base radios and console as well as mobile in-car <br />radios to the Police Department in the amount of Two Thousand Two Hundred Twenty <br />($2,220.00) Dollars; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUIVTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to, upon approval of the <br />City's Board of Control, to enter into a contract with B& C Communications, Inc. for service <br />and repair of base radios and console as well as mobile in-car radios for the Police Department. <br />Said contract shall be in a form and substance approved by the Director of Law, in substantially <br />the same form as Exhibit A attached hereto. Expenditures made by the City pursuant to said <br />contract shall not exceed Two Thousand Two Hundred Twenty ($2,220.00) Dollars. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, health, safety and welfare of the <br />City of North Qlmsted, Ohio and for the further reason that it is necessary that this ordinance go <br />into effect immediately so that there is no lapse in the service and repair of base radios and <br />console as well as mobile in-car radios for the Police Department, and further provided that it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />
